Timeline

Hello... I just came to know that the past 2 years when I filed my tax returns for work I did in the US, I filled out the incorrect form? I filled out 1040 instead of 1040NR... what should I do? call the IRS?????

Will this cause problems with the K-1 process? at what point will they look up my (Beneficiaries) tax information or do they ever???

please help. thanks :)

NOA'S Received: March 19, 2010

RFE: March 25, 2010

Case transferred to CSC: April 19, 2010

If you think you may have filled out the wrong form, etc, you can file form 1040X

Don't know for sure, but that is a good place to start looking. The instructions do list both 1040 and 1040NR, so maybe.

1040NR is for non residents (NR). You did file the wrong form if you were a non-resident. I doubt it would be an issue from an USCIS standpoint but from IRS, yes it might.

Try calling the IRS and they might just tell you to amend your tax returns and refile, though I doubt it. But call them just to be on the safe side. The tax rates are the same. However, I don't know what else varies in each form.
