NVC process - Deciding on I-864EZ instead

Hello everyone,

I have given much thought to this and dont recall reading anywhere that I have to file I-864 only. Looks like if I qualify, I can use I-864EZ form as well. I have the W2 and tax return transcripts for past 4 years with current employment and history of pay stubs. Feel like I have enough to go ahead and use the EZ form instead.

Any of you know this will cause me to get RFE. Also, I am not in rush as well. What do you think?

Please let me know specifically if you know that I have to only file I-864 form.

I used the I864EZ....

You may use Form I-864EZ IF ALL the following conditions

apply:

--

Write your name, Social Security number and the words

"Form I-864EZ" on the top right corner of the sheet; and

--

Write the number and subject of each question for which

you are providing additional information.

--

The USCIS website (www.uscis.gov);

The National Customer Service Center (NCSC) telephone

line at 1-800-375-5283 TTY: (1-800-767-1833); or

Your local USCIS office by using Infopass.

1. You are the person who filed or is filing the Form I-130,

2.Petition for Alien Relative, for a relative being sponsored;

2. The relative you are sponsoring is the only person listed on

the Form I-130 petition;

3. The income you are using to qualify is based entirely on

your salary or pension and is shown on one or more Forms

W-2 provided by your employer(s) or former employer(s).

Who May Not Use Form I-864EZ?

You must complete Form I-864 (and not Form I-864EZ) if

any of the following conditions apply:

1. The relative you are sponsoring is not the only person

immigrating based upon the underlying visa petition;

2.You filed or are filing a Form I-140, Immigrant Petition

for Alien Worker, for the immigrant you are sponsoring;

3. You are a joint sponsor;

4.You are a "substitute sponsor" filing because the original

I-130 petitioner is deceased.

I too plan on doing the EZ form, and I qualify. I wonder how many have used this form with no problems. Good Luck

Thanks marie620 for posting your response. Since you are too far head of us, I will definitely take your cue and file with I-864EZ as well.

Just got anxious having not heard anything about using this form from anyone and hence decided to open the topic.

And Good luck to you. BTW, how did the interview go - you did not update your signature I guess.

Hello Misr. Everything went along really well ... UNTIL the Interview. My husband was denied and we are working on getting that changed. I have posted awhile back which I update regulary as we move forward with this process.
