K-3 visa vs only I-130 (Which is better)

Timeline

From what others are saying here on VJ the CR/IR-1 process is less expensive (fees) overall and the immigrant has a green card upon arrival. Two big pluses.

I would like to hear from VJ members on what thier views our (On which is better , K-3 or I-130). I have heard that as long as you meet the qualifications (For I-130) it is very difficult to be denied. Any truth to that?

1) CR1/IR1 [i-130, immigrant visa]

Petitioner: US citizen or LPR

Approval till interview: Little longer than K-3

Cost and Duration for getting Green Card: Cost less and short time to have Green card

Travel outside USA while pending AOS: Green card holder, freely travel any where.

Relationship failure before permanent resident: Can not get Green Card (after GC option may be USCIS form I-751)

EAD: Work after arrival

Extension of Visa before filing AOS: Not Applicable

2) K-3 [i-129F, non-immigrant visa]

Petitioner: Only US citizen

Approval till interview: Usually shorter than CR1/IR1

Cost and Duration for getting Green Card: Cost more and longer time to have Green card

Travel outside USA while pending AOS: Freely travel inside and outside USA.

Relationship failure before permanent resident: No option to AOS, must leave US

EAD: Work after getting work permit and SSN

Extension of Visa before filing AOS: Permitted (USCIS form I-539)

3) K-1 [Fiance (e), non-immigrant visa]

Petitioner: Only US citizen

Approval till interview: Shortest

Cost and Duration for getting Green Card: Cost more and longer time to have Green card

Travel outside USA while pending AOS: Advance Parole require (USCIS form I-131)

Relationship failure before permanent resident: No option to AOS, must leave US

EAD: Work after getting work permit and SSN

Extension of Visa before filing AOS: Not Allowed

While Direct Counselor Filing (DCF) is quickest but may not work in many instances and only available to US citizen.

I-129F (K-3):

08/11/2008: NOA1

02/17/2009: I-129F NOA2: Approved in 190 days from NOA1 date

<not pursuing I-129F petition further but NVC forwarded case to Consulate on 02/24/2009>

NVC Journey:

02/19/2009: NVC Received/Case number assigned for I-130

02/20/2009: DS-3032 sent by e-mail and 03/04/2009: DS-3032 sent by regular mail

02/26/2009: NVC received DS-3032 Choice of Agent selection

02/26/2009: DS-3032 accepted and AOS Bill Generated but not IV Bill

02/28/2009: AOS Bill Package received in mail

02/28/2009: Paid AOS Bill and IV Bill (as it was available) online

03/03/2009: Both AOS and IV Bill Show as Paid and Coversheet Printed

03/04/2009: Mailed I-864 and IV (DS-230) Packages

03/06/2009: I-864 and IV Packages Received by NVC and Scanned on 03/10/2009

03/13/2009: Case completed at NVC (in 17 working days from date NVC Received)

03/25/2009: Interview date assigned by NVC

US Consulate @ Mumbai, India

04/02/2009: Medical Exam (based on NVC e-mail for interview)

04/13/2009: Interview Packet Received from US Consulate

04/16/2009: Documents submitted at VFS office

[Classified]: Date of Interview

02/21/2009: Permanent Resident # Received (Ref: NOA2 of USCIS)

You decide:

1. CR-1 is processing ALMOST as fast as K-3

2. CR - 1 is less expensive than K-3

3. Beneficiary has green card upon arrival with CR-1

4. CR-1 is a pretty secure way to enter the country given qualifications met.

02/24/09 I-130 and I-129f NOA2 Received (email notification) NOA2 in 89 days!! and 03/02/09 I-130s and I-129f NOA2 Hard Copy Received in Mail
NVC Journey:
03/03/2009: NVC Received/Case number assigned for I-130
03/11/2009: DS-3032/AOS Fee Bill Generateed (received via email); Emailed DS-3032; IIN# Assigned/Paid AOS Bill (online)
03/12/2009: AOS Fee shows "Paid" / Cover Sheet Available
03/16/2009: IV Fee Bill Generated (online)
03/17/2009: IV Fee Bill shows "Paid" / Cover Sheet Available
03/18/2009: AOS I-864 package received at NVC
03/23/2009: AOS I-864 pkg reviewed and approved at NVC
03/24/2009: IV DS-230 package received at NVC (also recieved an RFE for "not paying" IV Bill. Hello NVC!! It was paid already a week ago!! )
04/10/2009: NVC CASE COMPLETE in 37 days!!
US Consulate Manila, Philippines
05/04-05/09: Medical Exams (Round 1)
01/20/10: Round 2 Medical Exams - DAY 1 complete
01/26/10: Exam Day 2 - Immunizations complete, interview day assigned.
01/28/10: INTERVIEW - missing requirement of NBI with incorrect spelling of family name. NBI "AKA"received same afternoon.
02/01/10: Delivered NBI "AKA" to Embassy.
02/03/10: VISA Approved
02/25/10: POE Honolulu, HI USA.....Transfer to Seattle, WA....
04/10/10: Permanent Residency Card recieved.
04/25/10: SSN received
