This is the second time I have done a poll and I always mess it up. The poll wasn't there on the first thread (I added all the options but since I didn't add the question the poll options didn't show up) so I hit the back arrow one time and added the question (that created duplicate thread #2). Then I wanted to change the wording so I hit the back arrow one more time, changed the wording around and hit submit (that created duplicate thread #3). Whoops!

Most state laws already have provisions for dividing up property in a dissolution of marriage. For example, if you had a credit card debt prior to marriage, that is your financial responsibility alone. If you owned your car prior to the marriage, it is solely your car - unless you add your spouse to the title.

"In a community property jurisdiction, most property acquired during the marriage (except for gifts or inheritances) is owned jointly by both spouses..."

....

I don't understand the need for a prenuptial unless one spouse stands to earn substantially more than their spouse - like a professional athlete, for example.

I would think a prenup would be a reason for denial, at the embassy level, and at the AOS level for those adjusting in the US. How do you show a co-mingling of assets if the one or both of the parties has already segregated the assets into mine and yours? This seems particularly cruel to an immigrant that may be desperate to sign anything, just to get into the US.

What makes you think that the foreigner can only be the non-USC? You could still answer: "No, I wouldn't trust a foreigner further than I could throw one" and be the non-USC with more money than the American. You are 100% wrong on assuming that the foreigner absolutely has to be the non-USC.

For your second criticism of my poll, I suppose if you want to interpret "No. We are in it until death do us part" to mean that you can only be in it until death do you part if you did not sign a prenup. But that would be interpreting the text way too literally. When I wrote that response I meant for it to be "No. We're in it until the death of us. Who gets how much money if we divorce was the last thing on our minds when we got married."

next time give options like ''other'' if u can only think of a couple answers that suits you.

Next time don't analyze each poll word for word and try to find the slightest flaw. Better yet, don't participate in a poll that is just for fun if your going to take it so seriously.

Actually that prenup thing never came to mind, we were young when we got married (me-22, hubby-23). Whatever money we will have in the future it will be what we earn together, unless one of us wins a multi million dollar lottery............but other than that we are good with money. In any case I handle the finances in our home, he just earns and gives me his wallet :blush: and it will be the same once I start earning soon.

We didn't have money starting it and a prenup was never something we thought about. Both here and in Brasil the law without a prenup is that whatever we have after marriage is split down the middle, and that suits us just fine.

A pre-nup falls under family law. A visa falls under immigration law. All a prenup does is delineate what assets are whose prior to marriage. No judge would honor a prenup that basically says, "and in the event of our divorce, the woman dooesnt get shitt." For AOS purposes, the man and woman get a joint bank account, credit card, put her name on the gas, elect bills etc. A prenup has nothing to do with immigration purposes. Besides, there is a percentage of visa beneficiaries that are dishonest, and will plan to divorce hubby once the green card is issued, so immigration officials can understand the need for a man to try and protect his assets. Fun things can be included in a prenup as well, like, "the husband will bring flowers home to wife at least once per month, wash the dishes twice per week, and go downtown on me at least once a week." Really one can add all those things?? Damn! I wish I knew about it,would have added-- hubby gives back rub every night, hubby washes dish at least once a month and hubby not to get involved in his game so much that he forgets he has got a wife :P

Yes. The prenup is mostly known in terms of financial things, but it can be used to delineate the "rules of the relationship".

I saw a documentary of a couple that had each been married 4x before :blink: and they thought the only way for their 5th marriage to last , was to have all the rules written in a prenup. Their rules codified all the house chores, events/activities to attend on certain days of week. probably listed the frequency of sex as well, hehe.

Each time donald trump gets married to a contestant of his miss universe pageant, he puts in the prenup exactly what she will get when they break up, so sometimes the woman knows exactly what award she will get, so the woman does not always get the short end of the stick in a divorce with prenup.
