My I130 was originally filed by my mother, an LPR, at the end of 2005. She naturalized and is a US citizen as of December 2008, at the same time she sent the I130 upgrade form in to CSC. The I130 was approved and we got an NOA dated March 5th.

The approval NOA states the case as Unmarried Child Under 21 of US Citizen 201b INA. NVC issued a case number this week with the visa symbol of S1, but the status says that they are currently processing August 2002 cases.

My age is currently 24, I was 20 at the time of I130 being filed.

Isn't the NOA contradicting itself by stating child of US Citizen and 201b? Doesn't the first part mean an IR based unlimited visa and the 201b section indicate an LPR category? Also, what does the S1 symbol mean?

I am planning to contact the NVC on Monday and discuss the issue, but I just wanted to see if my line of thinking is correct before I do.

Under INA 201(B) the U.S. Citizen's spouse, parent or child (under 21) is considered an Immediate Relative.

When a child turns 21, and loses immigration benefits, this is commonly known as "aging-out". The law (child Status Protection Act, August 2002) seeks to prevent the unnecessary separation of parents and children due to aging-out. This act was revised again on June 2008.

<not pursuing I-129F petition further but NVC forwarded case to Consulate on 02/24/2009>

02/26/2009: NVC received DS-3032 Choice of Agent selection

02/28/2009: AOS Bill Package received in mail

02/28/2009: Paid AOS Bill and IV Bill (as it was available) online
