i was a K-1 visa holder in 2008 and entered in the US on my visa on may23 2008. i'm doing my taxes for 2008 and i was wondering if i 'ceased to be a Canadian resident' in 2008 even though i dont have a green card yet... and if i need to enter may 23 2008 as the date my canadian residency ceased... i still have my Ontario canada license and my car is still registered in ontario

Even though you still have minimal ties to Ontario - your car - you are considered a non-resident of Canada effective the date you physically crossed the border to live in the US and a resident alien of the US on the same date, even though you don't have a green card yet. Residency for tax purposes is not necessarily the same as residency for immigration purposes. :)

Try the Canada revenue Agency site here:

You need to fill out this form called 'NR73 - Determination of Residency Status (Leaving Canada)' :

I filled out this form, faxed it to CRA for 2007 and 2008 prior to filling out my taxes since I knew that my resiency had changed. I moved to the US in 2007 so I had partial residency in both countries - they considered me a Factual resident. Now, in 2008 I have lived here in the US for the full year and I am officially a non-resident.

There are some subtleties to non-residency status for sure - unless you officially tell them, they assume you're still in Canada or at least a resident for tax purposes, good reading on that site

One DOES NOT have to fill out and submit a NR 73,lol I didnt and was confirmed as a non-resident of canada.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

You're right - you probably don't - but I was told it was the approriate form to submit by CRA and it actually helped in assiting me to determine my residency.

It is the right form, but why do more paperwork, lol!! And yes Cassies's accountant told her she HAD to do it! Revenue Canada told me it wasn't neccesary! Been on numerous other forums, and many stated it wasn't necessary. Does it hurt to do it? probably not. I just hate filling out paperwork,lol

I (L) paperwork - in fact I wish there was more. I could practice my new signature, make it a litle more jazzy...oh no, wait - I juist get a freaking rubber stamp of it :D
