My husband wishes to adopt my 6-year-old daughter so that she could carry his name. How are going to go about that? My daughter and I are arriving in the US next week. How soon can he adopt her? We did not opt to have him adopt her here in the Philippines as it takes a long time. to do so..time which he doesn't have ashe cannot stay away from work for a long period of time. Also, are there any documents we would need to prepare for the process? I was not married to her biological father, nor has he acknowledged paternity hence the absence of his name on her birth certificate. I made an affidavit of illegitimacy when I had her passport renewed and another just in case NVC asked for one..which they did not.

your best bet is to speak with an adoption lawyer here in the US to find out what would be required.

Basically, get married and then he can do a step-parent adoption. It is generally a fairly quick, straightforward, and relatively inexpensive process-- especially if the other biological parent is not raising any objections. It appears you would have no problem in your case.

The actual timeline and documents needed vary from state to state, so as the other poster mentioned, it is best to contact an adoption lawyer in the area where you will live.

Wow! :o An excellent example of how the laws vary from state to state. In Louisiana, I believe the only requirement is that the petitioner have been a resident of the state for 6 months. But if both parties reside in the state, then there is no time period required.

Does anyone know about the Federal Income Tax rules regarding a step child.

For example, in a situation where Petitioner marries beneficiary with child, does the Petitioner get to claim the Dependent tax benefit starting the same year marriage took place, or does he have to adopt the child to get tax benefit. Thx

I filed to adopted my stepdaughter 2 weeks after she arrived in the US. It took about 1 1/2 months to complete. Lawyer cost me $1,000 he made it easy. Filing fees were $173. Different counties have different requirements. Most counties in Hawaii are EASY.

After 2 years of being married I filed for her US passport and got it. We were married in the Philippines.

Anak now has dual citizenship as she didn't have to take an oath for US citizenship. I haven't filed the N-600 yet.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I'm in the same situation only that my son is a 2-year-old and we're still waiting for our conditional GC. Someone in the other forum suggested to get the citizenship for my child first to lessen the confusion with USCIS. But me and my husband planned to ask our county office whenever we are ready to start the adoption and prolly get some ideas from adoption agencies.
