My my is US citiezen ,my brothers lives in europ. she applied for my brother 2002

filled out i:130 unmarried son over 21 in 2003

I30 approved in 2005

NVC 2009 requested for affidavit of support

NVC 2,3 2009 affidvated support accepted

NVC 5.2 2009 requested to fill out DS 230-1

My Mom is US citiezen she filled out form i130 for my brothers . he lives in europ.

she applied for my brother 2002

i130 approved in 2005

she got notice wait for remaining time

2008 recieved notice to pay affidavite of support fee.

my question is : Mom does not have incom. She does not have job or nor she worked at all

she recieve the money from SSI. which is government benefits.

my brother in LAW IS ready to be join sponser .

does my Mom suppose to fill 864 for my brother or only one person neeeds to fill it out which is my brother(which he has good incom top of poverty line) in law

help will be appreciated

if your mom is the petitioner, she will need to fill out an I-864 regardless if she has sufficient income or not. If your brother lives in the same household as your mom he should fill out the I-864A. But is your brother lives in another household, he should fill out another I-864.

we got A letter BACK from NVC asked to show the incom and 3 years tax.

yes you have to pass evidence of income with the I-864. they only require the latest tax return but with the option of passing in the last 3 years. Don't forget to pass in teh W-2s. and try to get a letter from your brother's employer to certify his employment, position and salary with his company

but NVC want the sponsers( my mom ) which she never worked . want her incom they tax return .

did she file income taxes? in my case i never filed income taxes cause I was a fulltime medical student. So what I did was attach a letter to explain why i didn't file taxes

i am not sure.. but your mom should attach a letter with a new I-864 explaining why she didn't file taxes the past 3 years. Good luck! God bless you and your family always. try posting your question in the IR-1 section. Maybe more people might be able to help you there. :)

I am gonna explain one more time. my brother lives in europ . my mom did the sponsership for him.. now she does not have any incom nor she worked in USA at all. right now in the physicall address she lives with my sister, and brother in law.

which form they should filL out for affidavid of support.

As based of my understanding , form I-864 is for sponser. and I-864a for join sponser.

if my mom fill out I-864 most of the question is all about incom , tax, currently employ. ( she never worked in usa at all) mad so confussion to me.

You would need a co-sponsor if your mom doesn't have enough income to support your brother.

You would need both I-864/A for the affidavits.

(your mom fills out one (864), then your cosponsor(864A))

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
