Filed tax returns as dependant of Father - NVC needs explanation.

Hello Everyone,

I need your input. My US born friend in the community filed for his wife I-130 and got approved - thanks God. His case is now in NVC and everything is in the last stage and one step away from Interview. However, he never had a steady job and was filed as dependent under his father for past two years. Only did he file as head of household in tax Year 2008. I understand that he only sent them W2 and Tax returns for tax year 2008. Now the NVC is asking for explanation why he did not file for his taxes in tax year 2007.

Should he come out straight and tell them that his father filed for him showing him as dependent. He has paper works for the prior years. Wondering if this will have bad effect on his I-864 application?

Looking for advice on how to proceed.

Sep 13, 2011 -- NOA received date.

Sep 29, 2011 -- Biometric appointment.
