What other implication is there from a 'wish this doesn't happen to you'? Statistically, it's not going to so I don't require your 'good wishes' for it not to. The only possible interpretation of what you wrote is that in fact you rather hope I do end up in a situation of this kind so you can be proved right.

The way I read it there's an implied inevitability that something "will" happen and the fact that it hasn't so far is presumably just because I've been lucky.

It presents an idea that firearms are somehow an essential necessary part of everyday life. Strange reasoning.

OK, well it could be that too. Either way, it's faulty because even where anyone to be involved in a random act of violence, there isn't any rule that says one will be in a position to do something about it, armed or not. Either one is lucky, or one is not. If one is lucky then a fire arm might under some circumstances prove helpful, but then again, it might not. A crowded restaurant is not a good place to start firing which is why trained police officers don't do it unless there is no other choice available. One has to assume therefore that perhaps this restaurant was not so crowded at the time of the shooting, of everyone was bloody lucky.

1 dead, one injured in Miami Burger King shooting

One man was killed and another seriously wounded in a shootout inside a Miami Burger King on Tuesday, officials said.

Police said a man wearing a ski mask walked into the store at Biscayne Boulevard and 54th Street and demanded money from a clerk.

A customer, who has a concealed weapons permit, pulled a gun, said Officer Jeff Giordano, a Miami police spokesman.

The customer and robber exchanged fire.

The robber was shot dead at the scene.

The customer, who had several gunshot wounds, was taken to Ryder Trauma Center in serious but stable condition, said Lt. Ignatius Carroll, a Miami Fire Rescue spokesman.

At about 4 p.m., officials got several 911 calls reporting people shot inside the Burger King.

Miami police released the names of those involved in the Burger King shootout Tuesday that ended with a dead armed robber and the seriously-wounded customer who shot him.

John Landers, 45, was the customer who walked up to the gun-wielding masked robber, 18-year-old Johnny Jean-Baptiste, when the restaurant's clerk was being robbed at 4 p.m. Tuesday.

According to police, Jean-Baptiste wore a ski mask when he walked into the Burger King at Northwest 54th Street and Biscayne Boulevard armed with a gun. It was a time, employees said, when it is usually crowded with schoolchildren and people getting out of work early. Jean-Baptiste then approached the counter, pointed his tiny semiautomatic Bryco .380 towards the restaurant's employees and demanded money.

That's when Landers, armed with a concealed weapons permit and his 9mm Glock 19, asked Jean-Baptiste to put the gun down, according to the police report.

Jean-Baptiste refused and began firing his gun and Landers shot back, police reported.

Within seconds, Landers had been shot in his chest, shoulder and arm -- and Jean-Baptiste lay dead on the restaurant floor, according to police.

According to police, Jean-Baptiste entered wearing a ski mask. He approached a clerk, showed his gun and demanded money. Within seconds, Landers eyed him and the two started arguing.

Jean-Baptiste fell to the floor and was pronounced dead at the scene.

Landers, who was shot several times, was in serious but stable condition at Jackson Memorial Hospital's Ryder Trauma Center.

After the shootings, police divided witnesses into several groups outside the restaurant to gather information about the incident. Employees waiting to start their shift called friends and family members on their cellphones to pass the time because they were not allowed through the police tape.

''I just hope all my people are OK inside,'' Cynthia Thomas, who has worked at the Burger King for five years, said at the time. ``It is scary.''

The area is a prime destination for residents in the Upper East Side neighborhood -- featuring Soyka's restaurant, Sushi Siam and Andiamo Pizza.

The gun used by the robber was on the list of top 10 guns used in crimes in the U.S. in 2000, according TIME magazine, which published a study by U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives.

The teen shot and killed in a robbery attempt at a Miami Burger King had been arrested several times as a minor.

Long before Johnny Jean-Baptiste was shot dead trying to rob a Burger King on Tuesday, the Miami teenager was a familiar face to police.

State records show the 18-year-old had been in trouble for selling cocaine and marijuana, aggravated battery with a deadly weapon, resisting an officer with violence and carjacking. In all, he had been arrested more than a dozen times. His run-ins with the law began when he was 15. He was first arrested in January 2006 for selling cocaine and marijuana. A few weeks later, he was charged with burglary followed by a battery charge in October 2006.

Within a year, police would again arrest him for aggravated battery and assault with a weapon and assault on a law enforcement officer.

Last September, he was booked for burglary, kidnapping and strong arm robbery. The disposition of the charges are not made public because he was charged as a juvenile. His last arrest: a carjacking in October.

On Tuesday, Jean-Baptiste was out on bond awaiting trial for the carjacking charge when he walked into a Burger King at 5398 Biscayne Blvd. around 4 p.m.

Wearing a ski mask and black gloves, say police, the teen pointed a semiautomatic Bryco .380 at the people behind the counter.

Customer John Landers, armed with a 9 mm Glock and a concealed weapons permit, saw the teen and confronted him, telling him to put down the gun.

Jean-Baptiste refused and fired his weapon.

Landers, 45, fired back.

Within moments, Jean-Baptiste lay dead on the floor of the fast-food restaurant, while Landers had bullet wounds to his chest, shoulder and arm.

No one else inside the store -- which is usually crowded with children leaving a nearby school and adults getting off work -- was injured.

Police said a someone in a car was seen driving off from the Burger King, but it's unclear if the driver is connected to the robbery attempt.

Landers was taken to Ryder Trauma Center at Jackson Memorial Hospital, where he remains in stable condition, police said. A hospital spokeswoman said he was unavailable for comment.

A neighbor said Landers, who lives in Hollywood with his wife, works as a photographer and writer. Landers' wife, said the neighbor, is a teacher.

''You have this feeling around him. If something bad happens, you can rely on him,'' said his neighbor, Anna Carina Nylander, 42.

Its possible also that he exacerbated the situation and created a gunfight that could have been avoided - if the guy was permitted to take the money and leave.

What if the perp was an illegal alien from Mexico? Surely, then, he deserved to be shot?

His legal status is irrelevant to the question. He deserved to be shot because he was committing an armed robbery.
