My son will be coming here in the US with a k4 visa. I have already filed I 130 and it has been approved. In 4 mothns after arrival he will be turning 21, the immigration policy stated that k4 will expire when the child turns 21. How are we going to manage this situation? Filing for AOS immediately upon arrival would be the step but then it will take time for approval it might happen after he turned 21. Please advise me on what to do.

We are in a similar situation where as the K4 was approved but the I-130 will probably not be approved until after his 21st birthday. From what I have heard, this is definitely not a good thing.

mY SON'S i130 will be approved before he even arrived here in the US. We will only pursue k4 just because it is a faster track for him to arrive here in the US. MY main concern is the length of time for AOS when he comes here in the US with a K4 visa. AOS takes time and he will turn 21 before we even get the AOS approval.
