I was hoping someone could answer this question for me. Will filiing for bankruptcy negatively affect an affidavit of support? Will filing for bankruptcy disqualify me or make me unqualified from filing an affidavit of support for my wife for the Adjustment of Status or when we petition for the 10 year visa? They don't do credit checks.

No they do not do credit checks

This is not true. :no: The do check out everything about you. It may not impact whether or not you get your visa but they do check your credit. We were given a 221G at interview and had to submit my bankruptcy papers to the embassy. Now, I am not saying that this will happen to everyone because some embassies just do whatever they chose. A bankruptcy will not have a negative effect on an affidavit of support. Do read the response from pushbrk.

Two things I have seen posted here that will affect issuing a visa....unpaid federal taxes resulting in a lien. If you have past due taxes and are paying them with an agreed plan, it will generally not affect the visa issuance. Also past due child support, and I think it must be in excess of $2500.

I have also seen some rare cases where they ask about bankruptcy as mentioned by a poster above but I have not seen where it affects visa issuance.

If they do any credit checks, I am not aware of it. It is not necessary for the federal governmen to do a credit check to discover a bankruptcy, such things are federal records, they know where you live for the last 5 years and where you would have filed bankruptcy. A simple check of that court's records will tell them.

It's individual but you debts become hers when you marry and your personal bankruptcy doesn't discharge her responsibiltiy to pay. If you can't complete the bankruptcy before marriage, she will be needing to claim bankruptcy too, or be responsible for YOUR debts. Talk to a bankruptcy attorney to be sure.

The extent to which SHE becomes responsible in YOUR bankruptcy is going to depend on the laws in your individual state regarding community property, etc. If you think there is a good chance that you'll need to file bankruptcy at some point in the foreseeable future, I would suggest consulting a bankruptcy attorney in your area BEFORE you get married so that they can explain the particular laws in your state. Many bankruptcy attorneys will provide you with a free initial consultation.

Financial issues and stresses are one of the leading causes of divorce. Even if she is not legally responsible for your debts in the bankruptcy, it WILL add a great deal of stress to the marriage.
