UNFAIR PRACTICE AT THE NIGERIAN EMBASSY

My display name is S&D4EVER. My fiancé visa was denied on March 23RD 2009 because the C O concluded that "The bona fides of the relationship have not been established ..." I am a former Publicist and the denial of my fiancé Visa has DISTURBED the HORNEST nest. It's a known fact that it only take 1 VOICE to bring about change, many times causing laws to go into affect! VJers, IT'S TIME to UNITE AND BEGIN TO DEMAND THAT OUR GOVERNMENT LOOK INTO THE UNFAIRl PRACTICES of how beneficiaries are treated during their interview (Stephen said he was asked a barrage of questions, barely given the opportunity to respond, and as a result, the C O denied his visa).

Too many TRUE cases (everywhere) are denied and the sham cases are approved by the obtuse C O who think they are god. I can recollect many years ago a government employee told me that they are to deny, deny, deny cases and those who appealed their case WON. She explained that that practice weeded out the weak and non SERIOUS ones, and the ones that put up a FIGHT (appealed the decision) was approved. Of course there are token cases because denying everyone would raise a level of suspicion.

VJers, are you aware that WE pay the staff at USCIS, NVC and the U.S. Embassies by the fees we pay? do the math! Can you imagine, we are paying them well to frustrate us.

I am REQUESTING THAT VJERS go to www.whitehouse.gov and bombard our President (who's slogan is "CHANGE") to look into the unfair practices being conducted at the U.S. embassies involving Immigrant Visas.

Already I have approached political figures requesting their assistance ... next stop ... the media.

If your S O was denied I would like to hear from you, even if your case was eventually approved.

Sorry to hear about your denial. Just on the statistics of this website there are a significant amount of approvals over denials. There are more satisfactory stories of the embassy then unsatisfactory. So unfortunatly you cries might go unheard. Get in touch with Sylvia and Joseph she has some same complaints.

I agree that if you persue your denial you will get it overturned. So keep the faith. I know a lawyer at this point his exgtreemly helpfull. It is important to keep your case at the embassy level.

I am sorry about the denial.

I have to agree with what MrsJ said: there are more approvals than denials (at least from the list I have been keeping). Unfortunately, I think that true cases do get denied and fradulent ones get approved. There is not going to be a 100% accuracy rate in a situation like this.

I think that you should definitely fight this, along with everyone else who is doing the same. This process does need some overhauling, I just don't know what the best way to do it is.

Sorry. What type of information did you submit as evidence? I notice that the title of your post stated "Unfair Practice ..." was there something specific that happened, or are you referring to the denial? Once again - sorry for your pain.

I agree that things need to change in Nigeria. If you look at the paten of problems in Lagos and some of the other embassies in Africa there is a pattern that is actionable . Actually 2 . One is a non black petitioner and a black beneficiary having a higher reject rate. That is racial bias. The second is older woman younger men. Age bias solely on the woman being older. The Philippines clearly show that older men younger woman are allowed. My trumped up reason for denial was so stupid I actually was able to report the CO for attempted espionage. What really needs to happen is a class action lawsuit against the DHS ( they are the agency responsible for what the embassy does ) for these violations. The "indicators" are documented in they handbooks but not applied evenly to men and women hence the potential for a class action lawsuit. Emailing agencies get you nice stock replies that they are forwarding your concern to USCIS ( like that is going to help) A lawsuit gets attention. The negative is once you sue the government you can no longer ask your congressmen/senator for help as they are part of the government.

Unfair meaning ... when the C O asked Stephen a question as Stephen began to answer the C O asked another, then Stephen would attempt to answer, then another question and Stephen wasn't given the opportunity to answer his barrage of questions, that's unfair to me. I don't know if you believe in prophesy (the Lord telling someone something is going to happen) but, Stephen's Pastor told us last year this was going to happen but because I'm not really into that (prophesies) I didn't believe him, guess the Lord is showing me, I believe Lord, I believe ...

The prophesy was: "Stephen was going to encounter problems with the process but eventually things would work out and the process would be smooth thereafter."

I'm sorry Stephen had such a difficult interview. In preparation for his next interview, you should practice interviewing with him. Ask him tough questions, easy ones, ones just to see how he can handle something unexpected. And give him a strategy to deal with a barrage of questions. Have him practice something like, " I'm sorry, but I have not finished answering your earlier question. Please allow me to continue, (finish answer). What was your next question?" Sometimes it helps to have a plan.

You said that he was denied (was he denied or was he asked to provide more evidence of a relationship?). IF it was a denial , you have a limited amount of time. His K1 will remain at the Embassy for a few days. After that it will return to the US. Research/Post on VJ. There is a way to prevent the K1 from being returned and fight the denial. Once its back in the US there is nothing you can do but start over. Read and be ready to act as soon as the Embassy opens on Monday.

Also, you said the reason for denial was a bona fide relationship was not established. I don't know what you submitted as evidence, but look over it and see what else you can do to make your case. Did you send phone cards(not evidence) or phone records (evidence because it will show you called his number)? Can you manage another trip to Nigeria?

I remember that my hubby had an interviewer who insisted his correct answer to a question was wrong. She even went as far as to say, "are you sure the correct answer isn't xyz?" And finally he said, "I don't know what it is that you want me to say, but the correct answer is abc." He got his visa. I'm sure I would have been very upset had he been denied, but I figure it is a strategy that is used weed out some visa seekers even if it is unfair.

No matter what, practice interviewing with Stephen. It will help him be better prepared and more confident after such a negative first experience.

AH ... yes they are really useless to process paperwork. I hired one too. I got $1000 of my money back in the middle of the process. Had I not had the stress of the process over my head I would have fought for every penny.

It is time to get refernces from someone who is experienced with your situation.

In high fraud states, itz good to go into "overkill" mode when presenting evidence for a bona fide relationship.

Do share what the deficits in evidence are, as far as the CO was concerned.

Isnt it common for Beneficiaries to undergo two interviews down there?

I just got an email from a distinguished gentleman in Nigeria, who was kind enough to inform me that I have $5.7 millionUSD waitng for me if I just simply wire him $24K. What a country!

Over kill ?

I have known Joseph for years and we had plently of things to show and over a years records of daily phone calls(which was about a 4 pound stack of phone records. He knew all the typical answers about my family and where I work. But they wanted to deny so when Joseph could not tell details of my work the CO basically said he either gives the details ( had he been able to do that I would have been fired) or no Visa. Unfortunately that crossed the line of a reportable attempt at espionage and she was reported. So her head trip will haunt her.
