Questions about AOS application...

Hi Everyone,

I came here to US since Oct 17, 2008 and got married Jan. 3, 2009. I still have not filed for AOS since my husband can't afford the $1010 yet for my application. How will this affect with my stay here in the US? I mean will this be a problem that I still dont have a GC? Im not in a hurry of working right now 'coz I am pregnant. One thing more that I am worried about is my TB skin test. Its about 5mm and so as we know my CS should take me for x-ray but he cant since I am pregnant. He just put a note on my I-693 about my TB skin test and that I cant have an xray coz I am pregnant. He look at my previous xray from the Philippines that I brought with me and he said its negative. That was taken last June 19, 2008 when I apply for US visa. My CS said its still good anyway since its less than a year when i had it taken. My big question is ... will the immigration deny my application for AOS because my skin is positive of TB and I cant have xray as I am pregnant? I am going to talk to my baby doctor too about my TB skin test as I am very worried about my pregnancy now... Right now Im praying as so hard for everything specially for my baby =( I hope u guys will pray for me too. Thank you.

03/10/2008 - Sent application to CSC

03/17/2008 - NOA

05/17/2008 - His 2nd visit

06/05/2008 - NVC issued case number MNL2008637XXX & forwarded our case to USEM

06/19 to 06/20/2008 - Medical exam schedule at St. Luke's Extension Clinic [PASSED!]

07/11/2008 - Interview Passed!!! God is so greatful!!!

10/17/2008 - Arrived in US POE - Detroit

01/03/2009 - Wedding day!!!

AOS

03/24/2009 - US Medical Exam (PTB skin test)

04/06/2009 - Adjustment of Status (AOS) sent to USCIS in Chicago

04/17/2009 - NOA1 Received

04/20/2009 - NOA2 Received

05/07/2009 - Biometrics

Timeline

K-1 allows a legal stay of 90 days, after that then out of status time begins to accrue until I-485 is filed, anytime during this period if for some reason you encounter a CBP "Boarder Patrol" officer, they can detain you for NOT having evidence of lawful status (Valid I-94 card, I-485 NOA1 letter (Proving AOS Pending), EAD card, or Green-card).

You are out of status now. Subject to deportation.

The baby and father will be USC. Don't assume that having a child will keep you in the US out of status.

Your husband can't afford $1010 for your application and you are pregnant?? If he can't afford that how is he going to support you AND a baby? Sounds like a less than ideal sitatuation.
