which EAD? they one you applied for or the temp EAD issued via the JFK POE?

your approved EAD should be valid for 1 yr ... if you have not rec'd your GC at that point, you will need to file (and pay) for an EAD renewal! :thumbs:

Hi gimygirl...well i came USA on k3 and i am in the process of getting EAD. i just wanna know when does this expire while ur AOS is still pending.

K-3 beneficiaries are given 2 years EAD. No need to renew the EAD after 1 year like the K-1.

01/22/10: Oath Date

June 01/09: Letter stating Petition Approved and Card Production ordered

July 12/09: Card Production ordered e-mail

July 13/09: Received card in the mail

March 27/06: Sent I-485

March 31/06: NOA 1

My wife is on a K-3 visa, and her EAD expires one year from the date it was issued and not her K-3 visa expiration date.

The trick to getting a longer EAD is to file for EAD before you file for AOS. I filed for the EAD as soon as I arrived in the US. I'm going to do AOS later when my marriage reaches the two-years mark so I don't have to remove conditions. My EAD expires two years from my initial US entry which is in May, 2008.

Since you filed for EAD at the same time as AOS, you're filing as a "pending adjustment of status". So you're given a one-year EAD just like the K-1 beneficiaries.

It's a dumb distinction but it's one of a few advantages a K-3 has over a K-1.
