AOS needed for I-130 ?

Hello ppl of VJ,

Already asked this but got no responce that answered my question.

My question is..MY USC husband is the petitioner of my two minor kids being his stepchildren. Once there petition(I-130 )is approved what kind of visa will my kids have?

And once they are here with me.. do my kids needs to Adjust their status as well?

Pls..help me and i would appreciate any ideas you can share.Thanks.

Timeline

I-130 results in and IR-2 or CR-2 depending on if your marriage is less than or greater than 2 years.

NO Adjustment of status, this visa type gets a green-card upon entry to the USA.

Moving this to Bringing family of US citizen forum.

Is now a US Citizen immigration completed Jan 12, 2012.

Am really confused coz my friends told me that CR 2 is for those kids of USC and IR2 is for immediate relative. My kids are not adopted by my USC but he is the petitioner for them being his stepchildren. Do they need to adjust their status once they are here?

Am really confused coz my friends told me that CR 2 is for those kids of USC and IR2 is for immediate relative. My kids are not adopted by my USC but he is the petitioner for them being his stepchildren. Do they need to adjust their status once they are here?

Step children are considered an Immediate relative just like a spouse is considered an immediate relative. They get CR-2 or IR-2 visa.

Will be issued an IR-2 visa if your marriage is more than 2 years, OR CR-2 visa if marriage is less than 2 years at time of interview, if they enter the USA after 2 years of marriage the resulting green-card should be 10 year un-conditional one for them.

NOTE: After they enter the USA, step parent can adopt them, and then file an N-600 for US citizenship, no need to wait 3 years of residency.

YuAndDan,,thank you really so much for this help. We will be married for more than 2 years by the time the kids will be scheduled for there interview. Our 2nd wedding anniv will be on May so they probably will get the IR 2 visa if everything will be ok.
