Sloppily written laws help no one and waiting for case law to determine how a law should be used places the end results in the hands municipal and state judges...asking "gray area" defendants to wait can backfire.

Today's news - even Mrs. Kanka, Megan's mother believes that a case like this - which would automatically register this girl if convicted - shouldn't fall under the scope of Megan's law...and for those of you who think this is the only 14 year old girl doing stuff like this, I got a bridge to sell to ya.

The last thing I would want to see is a law like Megan's Law repealed but it needs to be used as intended - unfortunatley Megan lost her life savagely to pervert who should have been locked up for life. There must be a better way...heck, if memory serves, in Oklahoma public urination was classified as a sex crime for a while too - placing the offenders on their sex offender registry.

Here's another case involving sexting where an 18 year old now has to register for life as a sex offender. He'll now be punished for life for this mistake. And unable to sponsor a spouse 10 or 20 years down the road should he ever meet someone internationally due to Adam Walsh Act.

I think everyone should read the article and obtain ALL the facts. What he did was a malicious act involved naked pictures of his ex-girlfriend who did not authorize them being publically displayed. It it not as the title seems, Sextexting.

Malicious act? Obviously the pictures were given to him by his girlfriend, which is quite common among teenagers these days. Sure he shouldn't have done what he did. But to convict him of child pornography, have him register as a sex offender, have his picture and address plastered on the internet. This is quite excessive for a misjudgment he made when he was 18.

So, using that logic, if the girl in the pictures was your daughter/sister, you would of course be as understanding, correct? After all, it is "misjudgment"

But they were not given to him to redistribute to others. Were they? That was a malicious act. Stupid yes, malicious yes.

I think there is a HUGE difference between the ex-boyfriend distributing them and what happened with the first girl and myspace.

The first girl CHOSE to place the pics on her myspace page - as insane as that is.

The girl in the second case had no control over where the pics went when her ex distributed them and IS a victim. Is she a victim because she didn't think thru what could happen by sending him the pics? Yes, I don't think anyone can argue that - she did open herself up to this being a consequence. But, he was under no duress to share those pictures - possesion of the pictures doesn't give the guy the license to distribute the pics and victimize her.

Most US states make a distinction when a child becomes an adult. These rules are well published. It is incumbent on the child and their parents to ensure the child knows the laws and the consequences of violating them. Sometimes, things you choose to do, affect your life?!

How is it that a "child" should be responsible for ensuring he/she knows the law? In most cases, the parents don't even know it (good, bad, right, wrong, or otherwise). Many parents, if you asked them, probably wouldn't even know the age of consent laws in their state?!? These laws should be communicated in the schools at the same time students are taught about sexuality (abstinence-only OR comprehensive). When you look at the statistics re: who's being arrested for sexually-based crimes you see numbers like 140/100,000 boys under the aged of 18 years - this is the highest rate of arrest for sexual assault in the US!?!? Of course it is when you add crimes like "sexting" or urinating in public to the list of registerable offenses. Being a registered sexual offender brings with it community notification, name/address/photo on the Internet, residency restrictions, Internet restrictions, special driver's licenses and plates that say "registered sexual offender" on it in some states, mandatory castration in Lousisana, posting of employer information online, inability to obtain employment licenses, denied entry to amusement and/or state parks, GPS monitoring, loitering restrictions, inability to work on ice cream trucks, custody/Child Protective Services problems - in many cases losing custody of child, getting kicked out of school or denied entry to higher education, not to mention the social consequences of being stigmatized, socially isolated, hated, with no chance of parole - these consequences get worse every year and NEVER go away. Is this really how we want to teach our youth that "sexting" is wrong? Is it appropriate to ruin the life of a child because of a mistake like sexting? Is this punishment appropriate given the act? If you ask me, I'd say many politicians are over-reacting in more than inappropriate ways.

The Washington Senate unanimously approved legislation Friday sponsored by Rep. Larry Haler, R-Richland, to protect all students from sexual predators at school.

Haler's bill, House Bill 1385, closes a loophole that technically allows teachers to have sexual relations with students over 18 years old, the age of consent in Washington.

The bill includes language to protect students up to 21 years of age from sexual predators employed by the school district. The new language would apply to both first- and second-degree sexual misconduct with a minor.

"I'm happy the Legislature sees the validity and importance of protecting our students from being preyed upon by school personnel, no matter their age," Haler said in a statement.

Haler introduced the bill after being approached by Richland School District officials after a sexual misconduct charge had to be dismissed last year against a former music teacher because the girl was 18.

For all the haters, if you think Sex Offenders should not be allowed to leave the country, then maybe you'd rather be neighbors with a sex offender that wasn't allowed to leave? And you may not know your neighbor is a sex offender, cause after all, its not like they want to advertise their crime.

So I guess if 20 years ago, that I was 18 years old and 1 day, and my gf was 17 years old and 364 days old, and I got caught, then I'd be labled as a sex offender with high risk of reoffending, and denied entry to another country.

Even though I've never had a jail sentense, I'm still labeled as an offender, and will continue to pay for crime for the rest of my life. At least I know I'm not alone on this. I plan to retire and leave this country asap, since its going down the toilet.

International Megan's Law of 2009

3/19/2009--Introduced.

International Megan's Law of 2009 - Requires registered sex offenders to notify appropriate jurisdictions of their intent to travel not later than 21 days before their departure or arrival in the United States. Imposes a fine and/or prison term of up to 10 years for failure to report such travel.

Requires diplomatic or consular missions in each foreign country to establish and maintain a countrywide sex offender registry for sex offenders from the United States who temporarily or permanently reside in such country.

Directs the Commissioner of U.S. Immigration and Customs Enforcement to issue directives for the assessment of sex offenders whose travel is reported to determine whether such offenders are high risk sex offenders.

Directs the President to establish the International Sex Offender Travel Center to monitor the travel of high risk sex offenders.

Authorizes the Secretary of State to rescind the passports of individuals awaiting trial for a sex offense against a minor or a permanent resident who has been convicted of such an offense.

Amends the Immigration and Nationality Act to make convicted sex offenders inadmissible to the United States.

Amends the Trafficking Victims Protection Act of 2000 to include in the annual report of the Secretary of State on the status of severe forms of human trafficking efforts of foreign countries to identify and provide notice of international travel by sex offenders.

Encourages the President to use authorities under the Foreign Assistance Act of 1961 to assist foreign countries in identifying and providing notice of sex offenders traveling to the United States and other countries.

Sets forth reporting requirements relating to the travel of international sex offenders and the implementation of this Act.
