I have a problem with my I130 approval letter!

Well my I130 was approved on April 13,2006 and they said in my email that they mailed me a letter. They didn't mail it to my attorney, to me. My attorney has not received anything. Neither have I. I have called the center and consistently put in my address. I did move March 1. I never received even a letter stating they had my information and changed it. Now the change was put in before my approval date and my ex landlord is a friend of mine, so she keeps any stray mail i get there. Nothing has ever come. The NVC does not have the file and on July 13, 2006 it will be 90 days. They all say that it can take up to 90 days but with this letter missing, etc. I have no idea. The NVC said they would get the file for me but i need to fax them the approval notice, said i didn't get it and they won't take an email copy.

Now they want me to fill out an I824 and pay 200.00 for a copy of the approval that i never got. I called the Post office, they checked everywhere and no letter. The USCIS said they didn't get the letter of approval returned to them. I am wondering if my file got mixed up in the fiance visas waiting to go out. This is a mess!

I am thining of writing them a letter, sending it certified telling them all I have mentioned above. What does anyone think? I am not paying another 200 for a receipt I didn't receive or lose.

That's unfortunate. I didn't know the fee is 200 dollars to get a reprint of the approval letter. That can't be right--is it really that high?

It happened to my I-130 approval too the only difference, mine comes up undeliverable (not our fault) my husband keeps calling the USCIS! first, they sent us letter which says takes 90 days to process but still didn't end that way.(long story) if you look at my timeline that's the reason but we didn't file the I-824 since it wasn't our fault and they sent us duplicate copy only takes a while. I'm not sure in your case, seems like you don't have other choice but file the I-824 sorry :( coz once it shows in their case that it was already mailed to you they'll not going back to that case again. but maybe you can try if your willing for the long time wait. Do you even need the NOA2 approval notice when doing CR-1. I haven't up to date and I got my visa early June. Noone has ever asked to sight a copy of it. Is it needed for removing conditions??? Otherwise I wouldn't worry.....not worth $200 if not needed for any specific purpose. K- visas need it when adjusting status but there is no adjustment of status for CR-1. I would keep a copy of the approval email.

Aussie I don't think I needed it. In fact I know I didn't need it in my case. I sent in the I-129F with only the NOA1. I sent a copy of the NOA2 later that very next week after I mailed in the I-129F but it didn't matter--the I-129F did not process any faster--I ended up with an Approved I-130 and the I-129F was discarded. So yeah the approval letter was never really of any use that I can recall.

We went through additional check on our I-130 - so NVC did not receive the petition file right after it was approved. Our application went through CSC supervisory check, it added 30 days (approx) prior to being transferred to NVC. But yes, it can take up to 90 days. It was up to CSC when to release the file.

I tend to agree about the NOA2 - that you would not actually use it for other purposes in later stage. I would like to know though the reason for the hold up at CSC. What did they say about the hold up ?

Did you call the 1-800 number for USCIS customer support or directly to the service center that handled your case. They DO have direct numbers and e-mails you can use when THEY make a mistake. And you do NOT have to file the I-824. That seems to bethe only thing the customer service center recommends.

Well, yes it costs 200.00. And no, I am not going to pay it. I actually wrote a letter I will send certified to the USCIS in California but no, I do not have a direct number for them, nor fax nor email. If anyone has it, please give it to me. As far as the receipt, thought I needed that to do the AOS. My husband is interviewing on August 23 for the K3. I was hoping my I130 would make it in time and replace it but it hasn't and will not happen. So...not sure where to go from here except for the letter or if someone comes up with a telephone number or email address directly to the center in Ca.

Why are you doing this work if you have an attorney? One of the benefits of retaining an attorney is to sort out these types of issues that are beyond your control.

I agree, why keep him when your are doing all the work.

But again - why are you doing all the work? This is one of those situations where attorneys can be quite useful. For example, there are phone and fax numbers into the Service Centers, and attornies have access to those numbers while we do not.

About the email address to the California center. Will they respond to me? When I asked the national center for a number to CA or a fax number, they said there wasn't any. They do all the work from them. I did send an email this morning with the link that was provided to me.

I know he goes to trial alot on Immigration cases, possibly this was not big enough fo rhim. I've known him for a long time but he seemed as though he didn't want to work on it. It wasn't unusual for him to see something like this happen. I don't know. And he didn't make any effort to give me the number or fax number. I kept telling him i was calling the center and what was going on. So what can I do? I have to do it myself.

The NOA2 went to your choice of agent. So who ever that person was is supposed to get it. I would imagine your attorney.

Probably sitting in some in-basket.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
