Waiting For Case Completion At NVC

My update: AVR says my documents are under review as of 4/10, so praying for case completion by the end of this week, and a May interview, though perhaps that's way too much wishful thinking. :innocent:

On the tax issue, I filed in February. I was married in September last year, but my accountant said I should file single as my husband isn't in the US, has no SSN, etc. etc. So I filed single, got a nice refund, but felt nervous about getting an RFE once my case got to the NVC. I saw conflicting advice here and elsewhere online. I finally called the IRS and was told that should I file married filing jointly. I got my accountant to redo my return accordingly, then I was slugged with having to repay the fed more than $700 :angry: Perhaps I should've looked into an extension (didn't know I could) but it's done now.

By the way, when you re-filed jointly, did your husband have to sign 1040? Did you have to fill out W-7 also like corrinne from oz? I know I am too late for all these, that's why I am filing extension..

Hi Champi. Oops, I meant to say I filed married filing separately, not jointly. So no, my husband didn't have to sign anything or get an ITIN. The 1040 indicates that he's a nonresident. It was all very confusing but in the end I feel like I did what the IRS asked, and for NVC's purposes, they can see I've paid all my taxes and am well above the poverty guidelines for a 2-person household.

just tried to log into online fee payment system and it says "you have encountered database error", anyone else?

Dated since 2004, 10/22/2008 Married in NY, wife left the country, returns on 01/06/2009 as a visitor (granted stay until July 2009)

01/15/2009 Sent I-130 package for CR1 to Chicago Lock Box, 01/19/2009 USCIS Chicago received the application

01/26/2009 USCIS sent out NOA1, 01/28/2009 Moneygrams Order cashed

02/24/2009 Case is in Vermont Processing Center (told by the USCIS by calling the free phone line)

03/02/2009 NOA2 mailed, application approved!!!! (47 days since we mailed I-130 package)

03/05/2009 NVC Received Case / Case number assigned

03/12/2009 DS-3032 / AOS fee bill generated and e-mailed to us, 03/12/2009 I e-mailed and snail mailed DS-3032 and paid AOS fee bill online

just spoke to an operator. the good news is that our AOS package has been accepted (although we sent only photocopy of our 2008 tax return, photocopy of W-2, letter of employment).

however, our RFE is not a false one. we got it for DS-230 part 1. something that i wrote there is incorrect as i understand. still cannot figure out what it could be, but all our supporting documents were originals so that was ok.

Sorry to hear about the RFE... But like you said, it's nothing too major. There are actually two good news: 1. Your AOS is accepted and 2. Your DS-230 is also reviewed and all documents are in place. Did they say if they will send you email about it or do you have to wait for snail-mail?

unfortunately, i didn't ask about this - whether they would email or sen it via regular mail, didn't know they do email. my guess is regular mail, but i am wondering who they send it to, beneficiary's address or petitioner's?

Since DS-230 is filled out by beneficiary, it should go to both beneficiary and his/her agent. Not 100% sure though..

Don't know what the RFE is for. Just got this AVR message this morning: NVC has reviewed your packet of forms and found information missing or incomplete...now i have to wait until Monday to figure out what it is that's missing...something with AOS package or DS-230...not sure.

oceansea1: The RFE could be becos your AOS was accepted and they are still reviewing your DS230.

AVR was reporting RFE on our case as well for the very same reason...don't panic yet :blush:

Hows everyone doing? I finally figured out how to file taxes which would allow me to make accurate estimates to file 2008 tax extension :D This weekend feels just too long. I really want some progress on Monday but at the same time, I don't want RFE ;) Have a Happy Easter every one :)

I also agree. AVR states they have received our biographic forms and that they are still waiting for AOS. HELLO??? They were both sent in the same envelop :bonk: Operator said AVR is not always updated properly and to not rely on it 100%. I was told to ignore it.

Champi, what do u plan on doing? I am filing mine as single come Monday. Man, I can't wait till the new week starts. This weekend seems longer than usual since I was off on Friday. I keep thinking it's Sunday today :wacko: A few more hours till Sunday anyways...Maybe if I sprinkle some lucky stars around, we can all move along super fast! :star::star::star::star::star:

Hi guys

I called NVC today as was told that No more doucments needed from my side and the case is under FINAL REVIEW.According to the operator my IV payment issue is not holdong up my case and she said ,she spoke to her supervisor and It will be updated by tommorrow.

My question is how long is this FINAL REVIEW on average and is it too late to get a May interview now??

Nov 1,08 Citizenship certificate sent

Jan 3,09 Case upgraded.

Jul 24,09 Pending,you can call every day for update but the day they call him for passport it means something is up so you get to know it before we do

Aug 06,09 Call from USEM requesting to submit passport

Aug 07,09 Every thing looks very good,visa issuance is up to the consulate!!!

Aug 07,09 USEM is requesting applicant's passport :)

Aug 17,09-call 1 Visa issued Aug 3rd,EM recvd passport on 10th but still havent returned it

Aug 17,09-call 2 Case pending some kind of processing (URGHHHHHHHHH NOT AGAIN)

Aug 18,09 call to pick up passport,picked up from AMEX

Sep 26,09 REUNION :)

Hey atk_721,

Congrats!!!! Final Review lasts a day or two, if I am not mistaken. You may want to post this question on the interview waiting posts as well. Couple of them have received 'final review' answers from NVC.

As for the may interview, the same VJ members in Interview waiting thread got answers from NVC operators this morning that interview schedule for May is closes.

'atk_721' - You should be done NVC this week (wednesday - thursday)
