Pakistanis...If You Had to Do it All Over Again...

Just curious...my fiance is a Pakistani citizen. If God forbid things don't go the way they are planned and he is not issued a K-1 visa...it was just a thought in the back of our minds...what route is the best for Pakistani citizens in Pakistan?

If you all with Pakistani spouses/ fiances had to go through the process all over again or had a chance to change your petition, would you still stick with the type of petition that you filed? Or would you go for a different one than the path you have chosen?

CR-1/IR-1, K-3, or K-1?

It would be great to hear what you all have to say!

I had not posted this in MENA, I posted this in the US Embassy and Consulate General Discussion.

You are almost there and now you have to deal with the embassy. This is the place to post your experiences or questions related to this last step before moving to the US. Topics relating to I-134's, packets sent from consulate and medical & police certificates should be posted here. Please post your interview experiences in the review section.

I am requesting that you move this thread back to where I originally posted it, please.

Are you sure about that, Marm? You may actually have thought you were posting in one forum while actually posting in another--if so, you're by no means either first or last VJ'er to do so.

(I can remember posting something in K-3 forum a few years ago, that really belonged in OT--where I thought I had posted it; when I found out the mistake, I contacted Ewok to move the thread over, and also posted a request--not honoured--for others to refrain from responding until it was moved)

Addressing the original question.

If you all with Pakistani spouses/ fiances had to go through the process all over again or had a chance to change your petition, would you still stick with the type of petition that you filed?

We filed for two petitions the K-3 and the CR-1 and both ended up at the USE Islamabad at the same time. The embassy canceled our K-3 so we had to go the CR-1 route. I do not regret it and try to advise if you are bringing a male over here to the states to go this route on a marriage visa. Males almost always end up in AP but once you are cleared and get the visa you are work authorized upon entry. No adjustment of status unless your category is CR-1 and that is two years down the road. AP can cause delays when you file for AOS again the states since anytime you file a petition it automatically has to go through the security checks again. (K-3 on here took her two years to get an AOS approval on her spouse from Pakistan). From 0/23/06 to 7/29/2008: card production ordered...918 days..can't wait to see that card!

Or would you go for a different one than the path you have chosen?

CR-1/IR-1, K-3, or K-1?

I would still chose the CR-1 route if we were applying today. Plus, years ago the process was taking longer and now it is much quicker.

Everything I respond to is from personal knowledge, research or experience and I am in no means a lawyer or do I claim to be one. Everyone should read, research and be responsible for your own journey.

But (as OP states) it's also in the Embassies/Consulates section; my take on this--OP started threads in each, they were merged and placed correctly).

I, the OP, did not start this thread in two places. I started this in the Embassies/Consulate section, then someone moved it without notice to the MENA forum, and then Charles moved it to the South Asia forum....

DEFEATED the whole purpose of this thread...

*sigh*

So back the the orginal question if anyone would like to respond...

If I had it all to do over again......

I would never had filed for a K3 and instead I would go the CR-1/IR-1 route. When we got married we knew NOTHING about visa's. We chose the K3 route because it was supposed to be quicker. The whole purpose of a K3 is lost on someone coming from Pakistan. You know the whole Life Act thing... bring families together. What a joke. So if I knew then what I know now.... definately CR-1/IR-1.

For a K3 Visa you must first file an I 130 than after you recieve your NOA1 for the I 130 you then file an I 129F. Once the NOA 2 is recieved it goes to the NVC for a short time and straight to the embassy. If you never filed a I 129F, and went through processing at the NVC then you are CR-1/IR-1. :luv:
