I am just new to this website and i need some help. My situation is quite complicated at this moment and i really appreciate any of your advice how what to do next.

I have been staying in the U.S since last Sept on a B2 VISA for visiting my US bf who is here for a master degree. IN between, i returned to Shanghai to visit family and friends from Feb 26th to Mar 8th this year. As you can see, i just got back here on Mar 8th, and my I-94 was given for 3 months stay. And soon after, i receieved the admisson information from a top university(the same one as my bf's) saying that i am admited for master degree studies from this fall. I surely want to go to school and planning to get my F1 visa from China. However, since my bf is my main financial sponsor for my study, it might be understood by visa offical at the consulate that i have immigrant intention. And my bf just brought up marriage last weekend and i have been checking the relative infor. It seems like because i am here on a B2 visa, i have to approve that i have no intention to marry when i arrive here. Because i have been staying here since last Sept, i obviously have quit my job. I don;t have house or anything but my parents living in China.I don;t know what i can use to approve that i didn;t intent to marry my bf when i arrived on Mar 8th.

Moreover, if i do get married here later and plan to apply for my student visa in China this Jun, would that be a DEFINITE DENY since i have married to a U.S citizen. I really want to go to school, so i am very confused about what to do here. I am wondering if there is anyone could offer some helpful information.

If you marry, and apply for your green card while here, then it is not necessary to apply for a student visa. You will be in the U.S. legally, pending approval of your green card (Adjustment of Status) application. The application will cost a lot of money, around $1,900 including fees, medical exam, photos, etc. You will need to prove that marriage was not intended when you applied for your visitor visa; and that you have a bona fide marriage complete with joint bank accounts and everything else.

If asked at the adjusted of status interview you just tell the truth. You didn't intend to marry or stay permanantely when you enetred the US on your last visit. I'd wait a couple more months before you marry tho as March 8 wasn't that long ago!

I don't know much about B2 visa, but can't you adjust your status from B2 to F-1 visa since you're already in the US? If that doesn't work, going back to China to get F-1 is a sure bet. I don't know that just because your boyfriend is your financial sponsor that they would deny your F-1 visa. When you get your F-1 visa, they just need to know that you or someone can pay you for school and living expenses. Just curious, why is your boyfriend paying for your school? What you can do also is to get money from your boyfriend, deposit it in your bank, and claim that you're paying for your school. As long as you show that you have enough money in your account, that should be fine. I say, just get your F-1 visa, get married later, and adjust your status from F-1 to permanent resident. If you get your green card after 2 years of marriage, you get a 10-year green card instead of a 2-year. Think about all your options before you get married! Good luck!

03/10/11 -- Notice of Action received (dated 3/7/11) (Day 4)

03/18/11 -- biometrics appointment letter received (dated 3/15/11) Scheduled for 4/5/11 (Day 12)

03/21/11 -- completed biometrics early! (Day 15)

04/19/11 -- got approved and card production ordered! (Day 44)

04/23/11 -- received 10-year green card in mail! (Day 48)

3/14/09 -- mailed I-130, I-485, and I-765 packets

3/16/09 -- packets delivered to Chicago Lockbox at 11:47 am and signed by R Mercado (Day 1)

3/23/09 -- Notice of Action received for I-485 and I-765 dated 3/20/09, but not for I-130 :( (Day 8)

3/24/09 -- Notice of Action received for I-130 at my husband's address (Day 9)

3/26/09 -- Notice of Action for biometrics for both I-485 and I-765 arrives! Scheduled for 4/8/09. (Day 11)

3/28/09 -- completed biometrics! 10 days early! (Day 13)

5/1/09 -- received an interview letter for 6/4! (Day 47)

5/5/09 -- EAD card production ordered! (Day 51)

5/11/09 -- EAD approval notice sent (Day 57)

5/14/09 -- received EAD card! (Day 60)

6/4/09 -- Green Card approved at interview and card production ordered! (Day 81)

6/10/09 -- Welcome letter received (Day 87)

6/13/09 -- I-130 approval letter received (Day 90)

6/16/09 -- Card production ordered (again???) (Day 93)

B2 and F1 are both non immigrant visa's.

Marriage is the simplst solution.

Just be honest at the interview. The fact that you spent all that time with your BF without marrying is one bit of evidence. If you wait a few weeks now to get married, that is another bit of evidence. I assume both of you are serious about marriage by now.

I would not think her boyfriend paying the school costs would affect the student visa.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks all for your advice.

Let me simply explain my F1 concerns since this is another nonimmigrant visa, i need to show as little connection with U.S as possible. My bf is willing to help with my school cost, its very kind of him, of course the school will have no problem with it, because my bf will sign a paper saying he will pay. However, one main goal for the visa officers in Chinese consulate is not to make sure that i have money to pay(since school has already done that job by issuing I-20). Their goal is to make sure my main purpose of going to the U.S is studying. My bf, an U.S citizen is paying for my school shows a strong tie to the U.S, i have high chance of staying in the U.S after graduation. That is high immigrant intent. And since changing B2 to F1 in the U.S takes too much time these days and also has a high rejective rate, I have to go back to China to do so. That is the risky part of F1 visa.

Regarding to marriage, my only concern is to prove that i didn;t intent to marry him when i entered two weeks ago or the time i applied the visa. I guess i have to take risk in either situation.

If adjusting from B2 to GC, what if the GC does not come in time and without a SSN, would it cause unnecessary complications with the school? You may want to check with the school also regarding the visa requirements?

Never marry before 60 days upon arrival!

Alternatively, you can call the USCIS hotline and ask them what they suggest you to do. You do not even have to give out real names if you are afraid.
