Will I EVER get to USA?

Hi MRSB: Im really understand how your feeling, cause it same as mine since my husband stared working papers. I can not sleep well, even after work in night-shift, i still stay up. im busy with baby and work but i think it can kill time pass quickly, but not. I think about our case all time, why arent we lucky like oher case ? we did not do wrong.

Just unhappy for my husband alone there, unhappy for our son can not see daddy....!!!

I and you should wait more how long ? when will we get news....????

Anyway, i just want to share my feeling with you,i hope you will get news soon. Take care your health. Just try to do something for kill time, i trust bad thing never happend to good people. we are real and we will get together with our husband soon !!!

Why do bad things happen to good people? you're right that the sun shines on everyone and the rain does too. It is not fair and it does not make sense to you or anyone else because you're not supposed to make it make sense, it's not right. I had no idea this world of injustice existed in immigration and like many people probably thought if you're married you should be able to live together. It is apparent that perseverence is the key.

I am not surprised that it hurts you when others look upon you as if you or your husband are doing something wrong, I too have experienced that is it just adds to the already present stress, I try my best to remember that we've done nothing wrong and they're just people putting it on one leg at a time like the rest of us.. so their opinion is not true and does not deserve time to dwell upon it. In time all those individuals will realize and find along the road of life that they probably did add to your stress and life will teach them - I believe that. With everything to worry about it's not fair to you to have to put energy into that when all your energy is needed to fight this tremendously difficult battle.

I know you are ill, your heart is ill. Expectation postponed makes the heart sick is a thought in the scriptures of the bible and it makes sense doesn't it? no one should have to do this. I tried to look for a support group locally when I thought I was going to end up in the pysche ward - a place that people misunderstand - it appears to be a place people end up who cannot cope with a trauma and are working it out it. idea of crazy takes on new meaning when you find yourself traumatized. I found the only group I could most relate to prior to finding this group was military wives. They wake up day to day not knowing if they will get good news or bad news. However they do get a date in which their husband/wife will come home to them.

I don't think you're falling to pieces, I know you feel unlike yourself, but trust me - a person is not meant to have to cope with this kind of stress and you are not weak for feeling the sorrow of it... it's not fair but I don't see you giving up either, which is a good sign. End will come in sight. Take care of yourself and will be thinking of you. Your story has really touched me.

So, we haven't heard from the senator or the update USCIS had promised, but my husband received a new letter from the USCIS about the I-129F (still) in which they've rescheduled HIS biometrics appointment for July 4th. They apparently cannot let go the I-129F or even correct the spelling in it. I don't know what to do, because apparently the I-130 has just been dismissed or something, got lost, whatever. My husband will go to the biometrics, since it seems to be the only option right now. I just don't understand at all anymore as to what is going on.

At least he can try to straighten out the biometrics appointment fiasco. :wacko:

He can also tell them exactly what has been goign on and ask for guidence on the best approach/next step

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Okay, my husband has his appointment for biometrics and stuff now on June 4th, which is... relatively soon. I hope SOME info will be provided. The senator's immigration specialist said that they ARE working on the I-130, not the I-129F and for some odd reason they need his biometrics for the I-130 (we don't know why). However, our I-129F which on Monday this week (18th of May) showed that it had not received a single touch since JULY OF 2008, has since received TWO touches all the sudden, on Wednesday and Thursday. Which indicates that they've apparently forgotten the I-130 and are going forward with the I-129F which still has our names spelled incorrectly... I just feel like getting a big, fat, trout and slapping all these people around a bit.

I'm sorry but I can't help but laugh about your humour at this point! it certainly made me laugh!

There's nothing like being slapped in the face with a wet fish!! :D

On a serious note though, I have followed your case from your 1st post & I don't have much help to offer but I'm sorry that you are suffering like this. It's just so unfair.

I think your perserverence will pay off in the end. Be strong! :thumbs:

08/17/09: Passed Driving test

08/22/09: Married on beautiful Mackinac Island, MI

10/20/09: Received AP

10/21/09 Received EAD card

12/7/09 AOS APPROVED!

12/14/09: Green Card arrived in mail. Happy Days!

It's taken 18 months from applying for K1 to receipt of Green Card! Thank God it's over until 12/7/11

Here we go again...

10/14/11: Biometrics

7/2/12: Approved. New Card Ordered

Finally, some good news for me. Not because of the visa though, oh no. BUT as of tomorrow, I'm starting at a new job, here in Finland! It's an internship that will (with the current contract) last until the end of July, after which it may be extended by a couple of more months. So I'll finally have something to do and less time to obsess about the stupid visa.

Also, interestingly... Remember when I said husband's got the appointment for biometrics with the I-129F in which his name was spelled wrong? For June 4th? Well, now he got ANOTHER letter from the USCIS for the biometrics AGAIN, this time for the I-130 for June 3rd... I can do nothing but laugh, this is getting way too hilarious.

I continue working (it's a hard job) and he continues to work in USA and we wonder if we will be together for our next anniversary in December... or not. I'm shocked that our case hasn't been expedited by the USCIS, considering all their #### ups. Life goes on, even though in two separate countries... Good thing we don't have kids.

I'm not sure if someone else has asked this or not but could you possibly withdraw your initial I-130 and re-file in a few months? Or have you already done this?

I am most definitely NOT refiling anything since none of this was our fault to begin with. We didn't spell anything wrong or make any mistakes, they've screwed up and they will damn well fix it or some heads will roll. I am rather just staying here than refiling and starting that ####### all over again. Nuh-uh.

wait...your husband is the USC, right? why is he being fingerprinted (biometrics) when he's petitioning for you? have you considered finding and employing a competent immigration attorney at this point? there is something very wrong, somewhere in your 'journey'. it seems that your attempts to get it fixed haven't succeeded. perhaps a trained professional can be of assistance.

I have seen cases like this - (one here actually) -

Looks like USCIS is not sure of the bona fides of the USC (background check) so they are asked to provide bios to move the case along.

I still haven't found the reasoning on USCIS, still looking.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
