do i have to do i130, before i do i129

i just recently sent my fiance i129f but i didnt know i had to do form i130 is it ok if i didnt sent it?

will uscis ask for i130

October 13, 2017 --NOA1

October 31, 2017 --Biometrics Appointment -ATL

ROC

April 5, 2012 --Sent I-751 to Vermont Service Center

May 21, 2012 --Biometric Appointment at ATL office

December 12, 2012 --10 year Green Card in hand

DCF Process

October 10, 2009 --Married in São Paulo

January 14, 2010 --Filed I-130 at São Paulo Consulate for DCF

May 17, 2010 --VISA IN HAND!

June 24, 2010 --POE in Atlanta

Ahem, Marina, the OP is asking about K-1 visa - at this point OP only needs to go with I-129f.

After the fiance arrives and they get married they will file for AOS which will include the I-485 form among others. Please read the AOS guide.

:no: I-130 is for SPOUSAL Immigrant visas, you are doing a FIANCEE visa, ONLY I-129F is filled for a K-1 FIANCEE visa.

I-130 is NOT used at any point of a fiancee visa process from initial filing all the way through adjustment of status.

NOT True either, K-1 adjust status based on K-1 visa, the I-130 is NOT used when a K-1 adjusts status.

ONLY if the K-1 marries the US citizen OUTSIDE the 90 days of the I-94 would they need to file an I-130.

Can you tell I did DCF and not K-1 :star: . I just saw it's actually the I-485 K1s use instead of I-130. My mistake - you learn something new every day.
