Hello VJrs! nice to be back here! We are just on our way to gather documents for the AOS but because of financial constraints and the need for me to have the EAD to be able to work soon is it possible to file leaving the K2 behind in just few months? We have 2 kids and with how bad this recession has affected my husband's income intime we got here last December (bad timing!!) we can't afford filing for 3. We went to the Dept. of Homeland Security and told them our concerns, we were advised to do so but I still feel unsure until I hear something from one's experience.

Please enlighten me on this, thanks a lot.

best asnswer is to do it sooner than later but later is better than never... what you give up is a price discount for any child under the age of 14 if not filed conccurently with the K-1 ($930 vs $600)

YMMV

Yes this is common, K-1 can interview first, and indicate that K-2 will be follow to join, the K-2 will need to interview within 1 year after K-1 is issued. If both are interviewed together, the K-2 can remain behind for up to 6 months (The expiration date on the K-2 visa).

OUR TIME LINE Please do a timeline it helps us all, thanks.

The wording of question is unclear sounds like leaving K-2s behind in home country.

Hello VJrs! nice to be back here! She uses the WE (meaning plural) not the I. Left behind as in AOS application... Otherwise a trip to DHS was not needed but a talk with the consulate.

Sorry to mislead you, I used WE since we're married and WE consider them our kids (L) ..Our kids are 11, 15 so we are really obliged to pay the $1,010 and $600.

As told also, they aren't after follow ups with kids as they are not able to work yet.LOL..

Thanks for the replies.

yes, and if the 11 year old files later (not with the K-1) the $600 become $930

YMMV
