Apply for J1 waiver now or wait?

My fiance is currently here on a J1 visa without the two-year rule, but was here previously on a J1 WITH the 2-year rule. We met with a lawyer this morning who informed us that he will need to apply for a J1 waiver because the requirement from the old visa still exists. He should be able to get the waiver based on the No-Objection Statement, but we are wondering when to submit the application to the State Dept. His current visa expires May 2009 and will be extended until May 2010. We are planning on getting married this summer and would like to have the waiver in-hand as soon as possible. Can we apply for the waiver now or should he wait a month until he receives the visa extension? By applying for the waiver, is he jeopardizing his visa renewal?
