Just got an email from CRIS they sent the letter today requesting initial evidence in the I 485 case. Not sure what that means.

I guess now I wait to see what they want :(

Nothing like waiting for bad news. Hopefully it's just a initial certificate of something.

Do you have any idea what they could want? You submitted the I-693, so maybe something with the I-864 or did you provide enough pictures?

Don't go crazy over it, it will probably turn out to be a little thing that you can resolve in a day or two. I cross my fingers for you!!!

I did my Biometrics today - piece of cake!!!

Just for kicks, I added my I-485 and I-765 case numbers to my portfolio, and they appeared, even though it still doesn't recognize my I-131 case number.

I looked in the I-485 file, and found this:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Case Transfered to Another Office for Processing

On May 8, 2009, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our CALIFORNIA SERVICE CENTER location for processing and sent you a notice explaining this action. Please follow the instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, call customer service at 1-800-375-5283 to update your address. You can use our processing dates to estimate when your case may be processed by following the link below. You can also receive automatic e-mail updates as we process your case by registering in the link below.

Does this mean what I think it means??!!?!?!?!!?

Did we escape the dreaded RFE????

Congratulations!!! My personal theory is that they transfer some of the K1's because they already had an interview and submitted proof of a bona fide relationship recently. I'm not sure if they look at the cases before they transfer it, I don't think so, they just send them off and they're worked on at CSC.

First, this means you have achieved transfer to the CSC; which also means there will most likely, be no interview at this stage.

As far as RFE’s the further you get in the process, the odds of an RFE do diminish.

There can be, however, RFE’s at each step of the process. It appears that Chicago makes sure the contents of the file are complete, as to the check list of required documents and signatures, as well as the submitted fees are correct.

Next, the NBC/MSC looks at the I-864 and the tax forms to make sure they are up to date (current year included) and we do see a lot of RFE’s while at this step. Most likely the decision, for the K-1’s at least, is made whether to have an initial interview, and forward to the CSC, or wait 24 months until time to apply for the ten year GC and then require the interview.

Next, is the service center, where the adjudication officer will do the final review on the file, to ensure that the bona fides of the relationship have been established, as well as the medical forms are correct and within protocol for the date completed.

At the Consulate level, you were dealing with the DOS. Now, you are back, again, with the USCIS. Two different animals.

BTW, we submitted photos with each package, at each step of the way, including the I-485 for AOS. Due to the high incidence of marriage fraud, both DOS and USCIS look very hard at all of these, at each step. They have a check list, and what amounts to a 'profile', which is made up of 'indicators' which may suggest a non bona fide relationship, or one that is real.

And remember, in the USCIS instructions, they advise to submit as COMPLETE a package as possible to assist them in their determination.

Some countries, such as China, get a harder look than many other western countries spouses do. ;)

I-130 for CR-1/CR-2 Timeline:

Married in Guangzhou, China 12-2006.

05/03/07: I-130's for CR-1 and CR-2 mailed to CSC via USPS

06/23/07: NOA-1/I-797C's.

11/06/07: NOA-2’s were issued. CR-1/2 Abandoned, for K-3/4.

11/06/07: NOA-2 approval issued for the I-129F.

12/06/07: I-129F for K-3/4 has been received at the NVC.

06/02/08: Interview passed at US Consulate Guangzhou

06/06/08: Return together and arrive at POE LAX.

I never thought it would be something to do with our tax papers. We only included 2008, because we exceeded the poverty line and we filed together in 2008. I guess it really good be anything for the RFE.

I'm so sorry! I wish the emails would say what the RFE's are about so you can be prepared to send whatever they want once you get the RFE through the mail!

I'm still waiting for the RFE about the missing pictures :( Also, I have not been able to add my AOS, EAD or AP to my portafolio on the USCIS websites, it just does not recognize my notices.

06/23/2009 back in the UK
