AOS Filers: April 2009

I am officially an April filer!!! I sent of my package today via usps next day mail!! now the WAITING!!!

Hooray, I am (well i will be) an April filer (just waiting for the full med exam to come back - had to do the full exam because it had been a year since the last exam in Rio)!! Quite late but worth the wait. Im a little nervous that USCIS is gonna be like ' why did you wait a year to apply for AOS' and my response is got laid off, financial difficulties, economy blah blah blah (yes, i have sponsor). I hope they'll be understanding. Ive heard of a couple ppl waiting a while to file AOS and it was no problem for them. Is anyone else a late filer? Someone who has bee married more than 6 months and is only now filing AOS? Anyhow, yay finally!

Today is the 27th 2 days to go for our Biometrics..Just remember to scan or copy those Receipt Notices, all of them..

We r going to an ASC Applicant Support Center..So planning to ask a few questions as well..on those forms. This is without an Info Pass Appt., so might as well make use of it !

We've been married for about 10 months and just filed our AOS. However my husband is on an O1 visa which is allows him to work. We've not had any problems so far, but I'm not sure our case has even been looked at. Our biometrics is on Wednesday.

We just got a letter today saying our case has been transferred to CSC!

Does this mean we don't have to have an interview? And that we're in the clear as far as RFEs go? We're a bit lost...

Oh, and one more question! As for the spreadsheet, are we counting # of days from NOA1 to transfer/interview? Or from the mailing date? Thanks!

I heard that transfer to CSC means that you don't have an AOS interview. Congratulations...

Congrats on being transferred!!! From what I heard it does mean you won't have an interview.

We are counting the days from biometrics app to transfer or interview. BUT when I inserted that column I was just copying from the March filers I recognized they took it down, so I assume that there is no connection between when your biometrics are done and a transfer/interview. I'd like to know your opinion whether we should keep it or not. I have no clue how to make a poll here, so please just post your opinion in this thread

Exactly. And that was the only reason I copied it from the March filer, because I thought there was a connection. I think it's more important to have a RFE column to monitor what's happening to the petition in that case.

Anyways, I'll take it down until somebody comes up with a valid reason to put it back in, and even then it that can be easily done.

Thanks! I don't think we'll have an interview. I'm not sure what the next step is. We can't see our case online so we've just been checking the mail every day. Still waiting on the EAD!

That is so exciting!!! I hope your EAD comes soon. I guess you just keep waiting like the rest of us, but I'm glad to see some type of movement.

Hey all April filers,

We just received an RFE today. We aren't worried about it, though, because its pretty easy to answer.

On our affidavit of support we had to use the income of a household member to meet the above-poverty threshold, and we neglected to include evidence that the household member was legally allowed to work in the US. I completely scoured the instructions before I submitted the I-864 and I-864A and it clearly stated that it was NOT necessary to send proof that the household member is a US Citizen (just proof for the sponsor), so I omitted it. The instructions said nothing about showing proof of permission to work legally in the US.

Oh well, I just made a copy of my mother's passport and we are sending it off first thing in the morning.

In any case, this means they are working on our case!

You have no idea how happy we are to receive this. Our K-1 process got stuck in a bureaucratic black hole and it took a year and a half just to receive an RFE!

So far everything seems to be going smoothly with the AOS application!

It really seems there is a little more movement going on with the AOS cases than what we experiences with USELESS USCIS during our K1 process.
