I have this friend I just met not long ago. She has come to the USA on a K1 Visa, The petitioner(hubby) Had changed his ways toward her and has a bad drinking problem. So she left him and now is staying at my friends place.

She is asking me these questions that I don't know the answers too. Like what can she do?

Can she find another man to marry, and apply for the GC. Or will she be deported when her 90 days are up......She is a good person, I wouldn't be here on this forums asking you.. if she wasn't..

She has been deceived like so many have.

Any help here?

Like the previous poster said, she would have to go again as only the original petitioner can really let her stay through marriage.

To the side, and this is something I see more often here, and I am not trying to be judgemental, although it may sound like it.. About this:

Can she find another man to marry, and apply for the GC.

That kind of makes it sound like it doesn't matter to her to whom she marries but just want to live in the US.. that's not how it should be.. she should only be here because of the person that she loves, not because she wants to be in this country.

For example, if I did not have my wife, if we would seperate for whatever reason, then I would go back to my own country as soon as possible also.. I am not here because I want to be here in this country, I am here because my wife lives here.

I agree that it is sad what happened to her but there is no way, and no reason, for her to actually stay here.

About her being deceived, I can imagine it feels like that but this story kind looks like she also deceived her fiance by wanting to marry someone else just to be able to stay here... just think about it ;)

Yeah sad but true. MORE AND MORE pinay ending up in deep da kine because of looking the other way and hoping to get to the US for a GC and better life for them and their families. Meeting for a short time doesn't normally work.

She may as well try and get her fiance to pay for the trip home. Going TNT isn't a good life.

Maybe better than her life in PI tho if she was VERY poor. TOUGH decision as unless she has family and friends here she'll be a VERY homesick little pinay.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

if she has money, maybe an Immigration Attorney...

this result is clear... nothing an immigration attorney can do except take money... the OP's friend will need to depart as her status can never be made legal without the assistance of the original petitioner

If the Hubby means she is married, there is a way ... it for abused wives or women that have been abused.

I check out and read a lot of stories under www.philippinenews.com and there is a Legal matters area and immigreation area.

I also read the stories on www.idexer.com about immigration.

So look to USICS for ABUSED and see what is written about getting and keeping a green card.

Sorry to hear this... there is about this there is a lot of DISHONESTY on both side Men and Women.

Sorry, with him (the "hubby") being a "bad drinker" is not grounds for "abuse" or a VAWA. With the limit info the OP gave, you can't make that assumption.

It seems the beneficiary in this case is more worried about her GC then anything else, if she is willing to meet a different man in the 90 days and marry him, for the GC.... :blink:

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If she is not married to her petitioner yet,,there is no way for her to find another man to marry her and apply for GC.She can only marry the person who petitioned her.

Tell her to go back to PI that is the bes thing she can do than being illegal here.After her 90 days is up she is out of status then and considered illegal alien.

She can only adjust status by marrying the person who petitioned her. If she does not marry him within the 90 days she becomes out of status and could be deported.

It appears that she is looking for a way to remain in the US no matter what, and such would be an illegal procedure, and we do not give advice on how to "cheat" the immigration on these forums.

Our advice on such matters would be: if she doesn't want to marry him anymore due to his behaviour she should return to her country as she has no rights as far as immigration goes to remain in the country with her current visa.
