USCIS turned upside down in late 2001, especially when any application involved someone from the Middle East. That can account for SOMETHING, perhaps. A true immigration lawyer is needed here to ask the right questions of the OP. Among other things missing, is how has he been supporting himself (legally) all these years. What evidence exists that the bona fide marriage broke up through no fault of his? Is there a record of a divorce to provide? He's going to need to make a very strong and serious case for being allowed to stay here, and without showing any disrespect for the way things are done by the USCIS.

Hi Ashkan. I'm going to move your thread to the Effects of Major Family Changes on Immigration Benefits forum to see if you can get some helpful advice..... there are a few really knowledgeable members in there.

As an aside, there are quite a number of members on VJ who waited years due to background checks so please disregard some of the previous posts. Good luck.

Do you know the real reason your wife left you? she wanted to start a family sounds like an excuse, you don't need a greencard to start a family, USCIS have no say over that.

Rrobin makes a good point to, would your ex wife be willing to help? having her speak to USCIS and provide confirmation you entered the marriage in good faith, were happily married and that you were not the reason for divorce would help a lot. There are alot of holes in your story but it does not mean that you shouldn't be given helpful advice..maybe the poster has a reason for hiding whatever he is, but I do agree if you really do want to get help you have to be 100% honest with us.

Bottom line is you need a lawyer , a competent lawyer but even with that your chances of staying in the USA are very slim.

we got married in 1998, had my interview in 2001, and has been pending since, in 2006 she left me. now i have an interview coming up next week and my lawyer says i will automatically be denied. do i have any options or that is it?

So, how did you first come to get to the USA in 1998? Were you already here when you married your wife? Is your wife a US citizen?
