Let me ask this when they are doing their "SECURITY CHECK", you have never asked

and/or questioned about your case. Normally after the interview, the decision should be made in 60 days.

Forget about your lawyer, you would go to your local congressman or US Senator to investigate.

That is so ridiculous !..... I have never heard any case like this......

your wife left you because she couldn't wait any longer? i don't get that part...

i honestly dont know man, all i know is she was there one day and not the next, thats what i heard from some friends of hers. that she wanted to start a family but didnt want to move out of USA if for some reason it got denied, as it was taking so long, whereas a lot of friends and family got their GC in two years or three, one even won it in a lottery

Normally you should have US passport in your pocket now.

Then you would not be affected if you guys got divorced or not.

Forget about everything in the past right now, done is done in the past, became history.

Look at the future now, what you are gonna do. If I were you I would complain

USCIS (about your application handling) to DHS.

(1) you filed in 00-01

(2)you had an interview in 01 'and the lawyer missed 'a paper'

(3) your wife left you and u didn't even know--according to u there were no signs

(4) it is now 2009! and you have your second interview

(5) u called uscis every 3 months between 2000 and 2009 and they gave you excuses?

you must see where i am going with this....there are obvious holes in your story. as much as i like to be fair and give everybody a chance, you have to do us the favor of stating your story as honestly and as precisely as possible. and that you haven't done! to say the least...your story makes no sense..

what you can probably do is explain in some more detail...what papers were the lawyer missing..etc. you come here for help but we have to pull stuff from u? explain ur situation clearly....

listen man, whether you take it seriously or not is irrelevant. i was hit with a bombshell today and am trying to figure out what to do,. yes all i said is as it happened. she was missing for 245 or something. the guy wrote in my passport, i can look it up. i thought i am going to get my green card and now find out i might get deported.

4 yes, i called california office where my case is and they said its taken too long and will do something about it, the interview icoming up is what they did.

5 i would call and ask so much i would hit my quota of 3 times inquiry so i would have to wait, i would wait and try again. no excuses where in the begining by mid 2004 it was just pending security check.

i have nothing to hide, i did nothing wrong, so i have no reason to omit anything that has happened to me. all i am trying to do is to find answers that my incompetent lawyer cant do so.

just to be clear...when u come here, u are looking for help..to get said help, u need to present you case as clearly as possible. if you choose to be vague and not provide details, you leave us to guess and speculate about you and your intentions. and that's just for starters!

if i were u, i would get a very sharp lawyer like somebody said before. i don't think that's a battle that you can fight on your own. but you see...it still doesn't add up because lets say your lawyer didn't have a form (i-245 which i never heard of and doesnt exist on the site) the most you would get is an rfe, and you would have 60 or 90 days to send in that information. you are yet to mention whatever happened with that form that your lawyer was missing.. what happened to your original lawyer. was the document ever sent in? how did it move from u having everything you need to you being subject to security check or whatevr u say it was? did u and your wife have a bonafide marriage? did you live togther? what happened how u didn't know that she was leavin you? normally there are signs. why haven't you gotten a new lawyer since you must know that you case is complex.

i hope you understand what i am trying to say....we wanna help u but you have to present everything that one would need to offer any sort of advice.

It does not matter where you come from, it does not take that much.

Actually it does.. I know someone who also had to wait several years before their name check was finally cleared.. and what to think about Estadia here on the forums.. she is waiting for 1.5 years already, just to get her I129F approved.

At the interview, You have to prove that you have entered into this marriage

by good faith & everything is legit and also you have an advantage because

she divorced you, that is a + point from your point of view. I give you 50/50 chanse.

Plus point for him, maybe, but the USCIS doesn't look at it that way.. they just look if someone is married at the time of the interview.. when someone does not have a GC yet and goes for the GC interview, but is not married anymore, then there is a very big chance that this person gets denied.

I recently read a news article about many people being denied because their spouses passed away.. the reason for USCIS is that they entered on a marriage visa and since they were officially not married anymore, they had no legal rights to stay any more.

The only reason, so far, of all the stories that I have read, for the USCIS to let people stay, is when the foreign spouse was physically or mentally abused and therefore had to cancel their marriage.

I am affraid that the OP would actually get to hear that he has to leave the US as there is no legal right for him to actually stay as he never received a GC yet.

Regardless whether this story is phishy or not, I would advise you to get a good lawyer, it will cost you, but if you have a right you will get it. No one here will be able to give you the "Lawyer/Client" confidentiality...

I missed a paper in the interview, very important one, however, I sent it the next day and was approved the next day.

Security check does not take more than 120 days no matter what your nationality.

My best estimate that the INS lost or dislocated your file. Given what you have stated in your posts.

Again, Get a Lawyer.

I feel sorry for you.

Firstly, I disagree with the notion that the security checks don't take longer than 120 days. There is a good fraction of applicants on all forums (including trackitt.com) who are stuck in security checks for years.

Secondly, can you ask your ex for help? It will help your cause if she can confirm, by a written statement, that your marriage was entered in good faith and was dissolved primarily due to the endless wait and future uncertainty which was a direct result of excessive delays by USCIS.

Thirdly, how was your first interview? Did you provide enough evidence for your bona fide marriage at the interview? Was the officer satisfied? "Security checks” is a blanket statement and could mean anything. Generally “security checks” or “background checks” mean that your FBI NameCheck and IBIS checks were not clear but it could also mean that IO was not convinced that your marriage was legit.

Consult with a couple of more lawyers to explore any feasible option.
