we got married in 1998, had my interview in 2001, and has been pending since, in 2006 she left me. now i have an interview coming up next week and my lawyer says i will automatically be denied. do i have any options or that is it?

Ask the different immigration lawyers.

If you can't prove you entered the marriage on good faith, then you probably will be denied.

If you do a search on this topic in this forum, you see examples of similar cases to yours.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

everything was legit, she couldnt wait anymore as she wanted to start a family and my attorney said, my case was pending and i could be denied and she didnt want to leave USA so she just couldnt wait anymore and left me, is now with her Ex

So, you are saying you haven't got 2-yr conditional card yet & still pending since 2001 !!!.

You must be kidding me.

There is something wrong here, buddy. USCIS takes time but that much.

Think about it maybe the lawyer does this on purpose to suck up more money from you.

she said my case was pending security check cause im iranian and nothing can be done, after calling and calling them i finally got thru myself and now i have an interview, but she says it will automatically be denied as my ex wife wont be with me and deportation will start. i cant believe i have no options.

It does not matter where you come from, it does not take that much.

Life is short, my friend. When are they (USCIS) gonna decide after you pass away ????

Also your lawyer is bullshit, I would fire her next thing in the morning.

At the interview, You have to prove that you have entered into this marriage

by good faith & everything is legit and also you have an advantage because

she divorced you, that is a + point from your point of view. I give you 50/50 chanse.

Btw, That theory "You will automatically get denied" is totally wrong !......

see, tahts what i thought, my whole marriage dissolved because they took so long and now to say its automaticly denied is not aceeptable to me, but two lawyers said that is what it is and they will start deportation preceedings

I have to accept that YOU ACTUALLY NEED A VERY STRONG AND SHARP ATTORNEY.

Because you haven't got the conditional GC yet. If you get divorced before even the interview.

You will be most likely denied except if you or your attorney will prove that the application process

took so long & some humanitarian reasons etc......You guys have to defend yourself. File I290-B & appeal also

but this will cost you money & time. GOOD LUCK !....

you know, something occured to me hearing what you said, i had my interview with my wife at 2001. at that time and we presented all documents, except one that the attorney forgot, so all was done and then it was pending security check and has been for the past 7 years, i applied in 2000 and had interview in 2001. so this is not the first interview. i was waiting for them to get that done and thru constant chasing got it done. now i have interview.

and/or questioned about your case. Normally after the interview, the decision should be made in 60 days.

Forget about your lawyer, you would go to your local congressman or US Senator to investigate.

That is so ridiculous !..... I have never heard any case like this......

That is so ridiculous !..... I have never heard any case like this......

i did, year after year, they kept saying security check, i had biometrics taken about five times, and nothing. then i started calling the california center and last one, woman said oh your case should have finished a while ago and sends me a letter for an initial interview, thats the mistake i believe. i had my interview and all was done. pending security check, so once check is up it should be done. no?
