Can anyone answer my question regarding I-134 for vietnam. I am planning to marry my girlfriend at the end of this year which is 2009 then do paperwork i-130,i-129f, then k3. I am self employed right now and making about $25,000 this year (2009). I did not work in 2007 or 2008. How many years of tax income return does the Vietnam consulate need when I file paperwork in 2010??? Is one year good enough and that one year is over the poverty line.

according to the rules, one should do it, but some of the posts I've read about that consulate leads me to think they want more proof/income.

You may want to ask in the regional forum?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

My husband (the USC) only had one year of salary that was consistent. And it did work. Basically, I think that they look for potential more than real salary. If I were you, I would just give it a try and, if it doesn't work, I would get another sponsor. But for the moment, you can try this way I think. Hope this help. It is all just based on my experience. Good luck with the rest.

They claim in the instruction package that they are looking for the tax transcripts for the most recent tax year. However, I have heard that they would like to see the last 3 years. You could go in with one but be prepared for a possible blue slip if you are close to the threshold. Ho Chi Minh consulate is very stringent.

What happens when I come in there with only one year of sufficient income and then they want all three of the most recent year, then I tell them I did not work the first 2 years just the recent one? Should I prepare the one year plus also a co-sponsor if I can get one before my future wife interview? I mean is that possible? If I were to prepare also a co-sponsor for backup in case they don't accept just one year of my income, which form am I suppose to fill out, the 134 or 184?

Co sponsors are not accepted at HCMC. The 134 just asked for the last tax return for self employed so you will meet the requirement. But as you will see, HCMC is a bit different. Welcome to the world of high fraud consulates. Be prepared to show more.

You may want to look into doing the IR-1 if you plan to marry in VN. It gets your wife a green card right away and will cost less in fees.

Do some reading in the Asia: East and Pacific regional forum. Lots of folks going through HCMC there. Welcome to the family :)

Anh map is incorrect stating to get a IR-1 as you have to have been married for 2 years to get one.

He/she also may be incorrect about co sponsors also.

So what is your opinion, I am really confuse, so does vietnam need 3 year of income tax or 1 year? Say during my future wife's interview, should she bring in 1 year of my tax return plus a separate co-sponsor tax return along with the i-864 for the co sponsor if they don't accept my one year tax return then she could give them the co-sponsor tax return information. I-864 is use for co sponsor, right if I am not mistaken, and I-134 is use for myself as a sponsor for k3 situation?
