Oh and take this advice...don't listen to ppl who know someone who knows someone whose cousin went through immigration.

01/10/2008........Two-year green card in hand.

08/08/2009........Our son was born <3

08/08/2009........Filed for removal of conditions.

12/16/2009........ROC was approved.

11/05/2010........Eligible for Naturalization.

03/01/2011........Separated.

11/05/2012........Eligible for Naturalization.

Caybee - I totally remember that episode too! Someone was stationed in Greenland??? They had the proxy wedding in the family's living room.... I feel old.

That's it. Richie married Lori Beth by proxy -- I think the Fonz stood in for Richie. Ack, I didn't even look that up. :blink:

Well everybody he's talked to in Egypt, even and attorney says proxy marriage is the fastest and best way.

Have you met in person yet? If not, as M4E said, Your petition won't make it past USCIS.

But that meeting in person is for fiancee visa, right? This would be spousal visa.

Do yourself a favor and research the proxy marriage ... Read the USCIS guidelines...

You still need to provide proof of a bonafide marriage. You need photos, letters etc...

You need to meet within the last 2 years regardless - unless you have very extreme circumstances. I mean crazy extreme - well documented religious/cultural reasons that can be confirmed.

I've always wondered if maybe the Amish would fall into that catergory...

A proxy marriage would have to be consummated in order to be recognized by immigration law here, which necessitates meeting in person.

According to the Adjudicator's Field Manual on the USCIS website:

Exceptions . Although the law of the land generally governs the validity of a relationship, it does not follow that all legal relationships will confer benefits under the Act. For example, a marriage contracted solely for the purpose of gaining immigration benefits and not intended to create a life together as man and wife, though valid in the place where contracted, is not valid for benefits under the Act, and a proxy marriage is not considered valid under the Act unless consummated. Furthermore, in some countries it may be possible to establish a same-sex relationship which is not in compliance with the provisions of section 7 of the Defense of Marriage Act (110 Stat 2419 amending 28 U.S.C. 115, prohibiting federal law recognition of same-sex marriages) and would therefore not be recognized for immigration purposes (see Chapter 21.3 ).

You cannot have a proxy marriage - all marriages have to be consummated. So, it looks like you're gonna have to make that trip to Egypt, take your vows and do the Nasty! :dance:

Yup. No other way around it.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Ok so yeah but then you could get a visitor's visa faster so you could consumate it?

Why would you think you could get a visitor's visa faster if you were married by proxy? To get a visitor's visa, he would need to prove strong enough ties to Egypt that immigration would believe he didn't have intent to immigrate. If you were married by proxy, that would be a pretty strong indication of intent to immigrate.

I would have photos and letters etc. Photos of marriage?

We provided photos of us together with the family, places we visited together, proof of purchases we made together. AND we have been together for a long time. I traveled to CR 8 times since we got married and I was worried that wasn't enough.

What is your need for a proxy marriage anyway?

Search this site. There are sooooo many posts regarding your questions. Google is your friend.

May 30 08-Baby Joshua was born

Jan 15-Back to NY we go...

May 10-made decision not to go back overseas.

July 10-filed for divorce

Jan 11-Divorce final

July 11-1st trip to take Josh to see George

Appears you have not met this potential spouse. Meeting and marrying immediately - especially since you were divorced not that long ago - could be a red flag.

No one can predict how an individual case will progress through this immigration craziness. Suggest you read, read and read.
