Guys, I am really hoping for the best. Why would they let her go and schedule an appointment if they wanted to deport her???

We were stuck in Chicago and live in Denver, CO.

Because they want to give her a break and ask her for voluntary leaving so she will be ban for less years than if she get deportation and will be ban for 10 years.

They can't deport her right away. They have to let her see an Immigration Judge first, that's the last step before deportation, and that's the last chance you guys can present you case. I'm not an attorney, but my suggestion is to be honest with the judge, just tell him/her that you simply forgot to file and bring the filled out plus signed I-751 joint petition form and all the evidence for bona fide continuous marriage with you and be ready to show the judge that you have now the intention to file removal of conditions. Of course one can argue ignorance of the law/rule doesn't = innocent, that's why an excellent attorney is needed when facing a judge.

Because as a permanent resident, she does have certain rights. Which might have been forfeited as you forgot to remove conditions. The removal process is indeed a process.

Again, I suggest you retain legal counsel.

Well, I got a chance to talk to an immigration lawyer and there might be hope. Before any deportation takes place you have to go to Immigration Court, so this is a little sign of relief. Now we are at the mercy of the system. Wish us luck, we are suppose to see him tomorrow.

• Approximately 90 days before the second anniversary of the date on which the alien obtained conditional permanent residence, the Service must (attempt to) notify the alien a second time of the requirement that the alien and petitioning spouse must file a petition to remove the conditional basis of the alien's lawful permanent residence.

While this might be true, during the interview a couple of weeks ago they clearly said that I would not receive an other notice besides the one he gave me at that interview. I had to sign a form in which I actually also state to agree with it and that it would be my own responsibility. The information on the website might be outdated, I don't know, but that's what has been said to me.

We certainly had our reminders besides the sign I taped to our refrigerator door, wife's employer could be fined for hiring an illegal up to $16,000 and with an expired green card, you are an illegal, they reminded her. The DMV would not issue driver's license renewal, wife was given a short term probationary driver's license that expired at the time of her conditional card expiration that was also a reminder. We were planning a trip to her home country, her passport was due to expire, that had to be renewed as well.

Was quite a shock to me during the AOS stage with all we had to go through, her maiden name key papers were mistyped with a V instead of a B, in a simple five letter name, this cost us literally thousands of dollars in her home country to have these government mispelled documents to have that correction made, plus the expense of having them translated into English. The the State of Illinois mispells my last name on their computer changeover, that only cost me ten bucks, but took three months. We go though all that and present a huge stack of evidence to learn since we were not married two years, only get a two year card. Also the huge out of pocket expense for the I-693 that seemed crazy to me as they could have had every disease known to mankind but only had to agree to counseling to get in. Fortunately, both my wife and daughter were clean.

Hardly came home from the AOS interview after writing down that I-751 number and read about no work, no travelling a possible deportation if you fail to file on time. So spent a lot more money getting my wife's name added to my possessions. We had everything prepared well before the 90 day time limit, but after reading the net on how long it was taking, wondered why it's only 90 days. Only to get that stupid one year extension I had a hell of a time explaining to her employer and to the state DMV. Then it took 14 months and one week before we actually got that card from the time we sent in the application. Was all set to make an infopass appointment as our USCIS field office won't see us until we are within two weeks of that one year extension notice expiration date. It was crazy.

This led us to learn we could apply for the N-400 proving LPR with her expired green card and copies of her one year extension precisely 90 days, well 89 days as that occured on a Sunday. Wife is a USC now, but these times were extremely stressful for us as I am sure for everyone that has gone through this.

And the USCIS does not send you any reminders and they do not mutually agree on their appointments dates, you either show up at the precise time, or you are screwed. Perhaps having six years of my life taken away by this country to serve in the military has brainwashed me, just one second late and end you up in the stockade for two weeks, no excuses for being late, and what is this stuff about freedom?

Jeez...all that happened in Illinois you said? Holy #######. Another reason for me not to live there in case their denial of my basic constitutional right and level of corruption wasn't enough. So, they wouldn't give your wife with absolutely legal papers a DL and DMV and treat you like #######, but the governer can sell senate seats and not even get in jail for that? Wow! In VA i didn't really feel much impact of green card expiration. My employer never even asked to reverify my status when my green card expired. And DMV took my one year extension letter and didn't even ask ####### is that. My DL was also due to expire the same day is the greencard, so i went to DMV with the extension letter and expiring card and they extended my DL for exactly one year in like 10 minutes. They even charged me less that normal since the DL was valid only for about a year, not for the full 5 year period as they normally issue them. By the way, there is a trick with employer not to get harrased about expiring GC. When you get the first 2 year GC you can go to Social Security office and get a new SS card without "Valid for work only with DHS authorization" note on it. Even though GC is only valid for 2 years, they still do that since you are a permanent resident. After that, all you'll need for employment eligibility verification is your DL and SS card - just like any USC, no green card is necessary. Now if you didn't remove the conditions and became out of status, i imagine SS will be notified and when your SS number is used for tax paying purposes, employer will be notified. But as long as you are legal and follow the law, this a loophole to verify your employment eligibility.

Back to the topic, I personally cannot imagine how you can just forget to file I-751. We were very aware of this date coming up and had everything ready well in advance and mailed the package exactly 90 days before 2-year GC expires.

No, I did not. The green card showed up only 8 months ago, and I failed to look at the expiration date.

you said 8 months ago?? isn't the card good for 2 years?? and your wife should have known better since you guys went out of the country vacation, she should have thought about it and stuff that needs to be taken care of..blaming is late but i hope you guys sort this out successfully.
