US citizen getting married in Montréal, Qc with a Canadian Citizen

Hi everybody,

My fiancé and I want to get married in Montreal in the summer... After that he will file a CR1 visa for me to immigrate to USA.. He lives in Miami,Fl and I love in Montreal. We will get married in the court house and I already have the paper that we need to have the marriage license but I haven't went to the court house because I've been hesitating, I'm scared that because he is not a Canadian Citizen or Resident, they will report it to the immigration and when he will come to Montreal in the summer, they will deny the entry and loose all the money for the wedding etc..

So my question is: Can he enter as a visitor and get married her in Canada without any problem? and Is it possible that the court house will advice the immigration (Quebec or Canada) that he wants to get married here with me and then deny his entry??

Hi Marie. The courthouse will not report your wedding to immigration. The only way they will find out is if one of you tells them. (via your visa application or otherwise)

I have no experience with visitors coming to marry in Canada and then leaving but I imagine it's the same as visitors coming to the US to marry. As long as the visitor carries proof of ties to their home country then they shouldn't have a problem. Here's the link to information for non-residents:

I'm less worried now.. I will check the website thank you very much.

Right, he is not coming to Canada with the intention of staying, just the wedding and visit me, later he will apply for the CR1 that way I'll go and live with him in the USA..

We have been together for 3 years and now we are ready to get married. His family want to visit Montreal so the perfect occasion is the wedding =).

We have been traveling without any problem.

My husband and I got married in Ottawa. We had no problems. However, at customs when they asked the purpose of my visit, believe it or not, I forgot I was getting married and said I was there to see my boyfriend. LOL. They always make me nervous because they ask so many invasive questions. So I don't know if it would have made a difference if I had said I was there to get married. Now when I enter and I say I'm there to see my husband, sometimes they ask to see proof of a round trip ticket.

Jejeje thanks for sharing.. That's the kind of omission that needs to be done, not saying that he is coming to Montreal to get married to me lol.

Instead of starting a new topic on the exact same topic, I'd like to ask a question relating to this exact thing.

I want my fiance to come up and marry me so we can do the IR1-CR1 process.

Is it best that he says he's coming up to visit friends instead of saying that he's getting married?

Because when I tried to do that going to the US, they flat out denied me, and I don't want him to get denied.

Should he be okay as long as he says he's visiting a friend and has a return ticket? (He has no intention of staying).

Though, he just visited me, so... I hope such close together visits won't be a problem with them.

Are you saying that you made plans to marry in the US but lied about it at the POE? If so, you are going to need to do some reading in this forum: Waivers and Administrative Processes

The best advice we can give you is for your fiance to follow the lead of the officer. He needs to answer only the questions which are asked of him and offer nothing further. He is to answer honestly. If the questions turn toward immigration intent he can respond that he and you will be applying for a CR-1 visa and you will be moving to the US.

Most likely they'll ask him why he is visiting - he can jsut say visiting his fiance. It's not a technically a lie and won't raise any flags. Of course they ask more questions, he'll have to tell them... but honestly, Canada is much more lenient so I doubt he'll have any problems... especially if he has a return ticket.

Not sure what your situation was when you tried to cross before, but they obviously thought you were going there to get married and not come back to Canada which is a big no-no. You can go to the US, get married and then go back to Canada and file for your visa.
