Hey! Its my first post here and I really need your opinion!! I got in the USA on January 3rd and my I-94 will expire on April 3rd...i just waiting for my Civilain Surgeon to send me my I-693 (by the end of this week) and then I will send my paperwork out to Chicago...Now, my I-94 will expire before I receive my NOA1 even if the paperwork will be sent on time...how can I prove my legal status untill I receive my NOA1? Thanks for your help and this is a great forum!

Without the NOA1 you can't.

That shows you are in the process of AOS and "freezes" your status till it's approved.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

just stay out of trouble and don't leave the country... make sure you file on time and before the I-94 expires

That shows you are in the process of AOS and "freezes" your status till it's approved.

Oh, ok! So will I be consider an illegal?

If you have the NOA1 for the AOS with you, no, you are awaiting status change.

If you do not have it, you will be considered "out of status", and subject to some intense screening, usually by ICE if your subject to inspection. It could be rough, and they would be in their rights to deport you.

Doesn't happen often, but it is a possibility. There is a case in one of the forums here where a couple were stopped at a ICE checkpoint, and they didn't have the AOS yet, just the marriage certificate and an expired I-94. They made it through, but it was close.

So I wouldn't plan on any travelling till you have it in hand :)

Mmm... that is scary...I will for sure send my paperwork out before my I94 expired so I hope it will only be a matter of days before my NOA1! Thanks for your help!!!!!!!!
