Problem with the decision of my annulment

I was annulled in November of 2006.the findings was my ex husband is psychologically incapacitated.In my annulment decision it was stated that my ex left Philippines in 2004 to attend seminar in America and no intention to return and it also stated that i learned my ex returned to Phils but did not stay with us. (me and my daughter) ....the truth is he left philippines 2001 and never come back till now it was abandonment ....my lawyer told me that the respondent should appear he is in philiipines the time i filed my annulment coz i will spend more money in publication. i paid 140k and i shoulder all of it....i dont know how to justify it to the consul and i know they will do background check and will see when my ex left and never exit USA....and one thing more i even asked for his deportation sometime in 2004 ..i emailed fraud unit in manila embassy .. and they told me to produce necessary documents to prove iam telling the truth thats what i did but nothings happen. Please enlighten me on what to do? I annulled my marriage coz i wanted to be out of his life completely ... and after so many years i found a wonderful man that i can trust and love again.

I see that your marriage was annulled in 2006 on the ground that your husband was psychologically incapacitated to comply with his marital obligations. I don't see any problem with the decision of your annulment. The court granted your petition for annulment, right? That's what matters. It means your marriage was declared null and void from the beginning. It means you can remarry again. As far as your ex-husband is concerned, you have done everything for his deportation and nothing happened. It's not your problem anymore if he committed fraud for overstaying in the United States. It's time to move on. Go girl!

When I had my interview, the pre-screener and consul did not ask me about my previous marriage that was annulled. I just gave them a copy of the decision and the decree. All that matters for you to qualify for a visa filed by a US husband or fiance' is that you can provide proof that your previous marriage has been terminated. Make sure you also have NSO copy of your previous marriage that has an annotation and stamped that it was annulled on this date at this court. They will only asked about your present relationship with your US fiance.

05/29/07 sent I-130s for me & my daughter at CSC

06/16/07 checks for I-130 cashed

06/19/07 sent I-129F not waiting for noa1 but with printed online copies of checks cashed

06/25/07 check for I-129f cashed

06/29/07 transferred I-129f to CSC

07/03/07 received noa1 in the mail for I-129f

10/31/07 approved K3 and my I-130 except for my daughter

11/05/07 received NOA2 in the mail

12/01/07 received mail from NVC/yey we got our case number

12/20/07 went to St. Lukes and had my early medical exam

01/30/08 schedule for medical

02/07/08 interview, approved!

02/12/08 visa pick-up/cfo

02/14/08 POE-LAX

06/19/08 AOS mailed thru USPS

06/22/08 AOS delivered to Chicago IL

06/28/08 check cashed

06/30/08 received NOA1 dated 06/25/08

07/26/08 biometrics appointment

09/09/08 received EAD card in the mail

12/03/08 received interview letter for Jan 21 2009

01/21/09 approved for conditional permanent residence

02/02/09 permanent residence card arrived in the mail

10/21/10 submit form to remove conditions

Thanks for the replies mga sis should i tell them the truth about what happened if they asked me about where is my ex ... but right now i dont know what place in USA is he now?

The grounds for my annulment was also psychological incapacity. The pre-screener and consul did not ask me where my ex-husband was. But if ever they asked me I will tell them that I have no information on his whereabouts and has no communication for the past 8 years. Do not worry too much about your ex. The US embassy is only concern whether you have a valid relationship with your American fiance' or not and whether your previous marriage was legally terminated.

why did u e-mail the fraud unit for?like what they said,you're good to go.during my interview,the pre-screener asked only for the NSO copy of my MC with annotations.I even had my son with me at the interview,the CO didnt ask my son the whereabouts of his dad.so dont worry about it.just prepare all the documents that are needed for your interview.most of the questions that'll be ask will be all about your relationship with your fiance and will be based upon what you have written on your I-129F and from the rest of your K1 application :thumbs:

I emailed the fraud unit the time i was not yet annulled ..to check if he exit us. but the fraud unit didnt contact me even once .

If they ask about your ex just say you have no idea where he is. They will accept you annulment papers and wont be interested in the location of your ex.

thanks for this topic. im on the same boat. got my annulment decision last dec 2008 and my fiance immediately filed for k1 visa petition at uscis, ca. we're hoping and praying things will go on smoothly so we can be permanently together soon.

as long as your annulment was final and you have the finality papers, then i think you wouldnt have a problem. i dont think the consul would go out of his way to dig into the details of your annulment.
