My wife's sister was originally accepted on an f-1 student visa from Vietnam and enrolled in 11th grade in a public high school. After the 11th grade, she found another public high school that was willing to issue her another i-20 for enrollment in 12th grade. Upon preparation for college, her current high school contacted SEVIS to find out the best way for her to enter college. That was when SEVIS told her she has to return to her country immediately due to the fact she was out of status. SEVIS told her high school that they should not have issue her an i-20. Currently her high school is allowing her to finish high school and receive her diploma, which is 2 months from now.

I want to know the best way for her to continue her education in America. Would any college accept her? Does she need to find someone to get married with? How about adoption? She is currently under 18. Please let me know the best way. Your help is appreciated. Thanks.

She is out of status and subject to deportation.

Where does she live in the US? She is out of status and subject to deportation. But there are a few universities in the U.S. that may be able to help her. Getting married just to stay here is out of the question and illegal. Adoption is also not an option because it can't be done legally in such a rush.

I'm sorry to hear that! But what kind of Highschool issue I-20 for F-1 visa? As far as I'm concerned, F-1 is for colleges and Universities, that might be why USCIS told you that she was out of status. I'm sorry that she was mislead like that. It is sad because she was just doing what she thought was right.

Another way would be to try and get her back in status. I was out of status twice while I was an F-1 status. Just call Uscis hotline, and ask which form you should file. I have a question, how was she issued an I-20 when she went to the embassy? By that I mean which school was she suppose to attend? Depending on your answer, I might be able to help you with advice. But by any means, do not try and shortcut the system man...

Just because she is out of status means that it is game over. She could still be reinstated. It is one of the advantages of F-1 visa. You can fix it without having to go back home. That is why there is no expiration date per se on the I-94 which should say D/S ( DURATION OF STAY). As long as she wants to keep going to school she can be reinstated. Let me know man!

I'm sorry to hear that! But what kind of Highschool issue I-20 for F-1 visa? As far as I'm concerned, F-1 is for colleges and Universities, that might be why USCIS told you that she was out of status. I'm sorry that she was mislead like that. It is sad because she was just doing what she thought was right.

F-1 is not just for post-secondary education. Students - in Public Schools - Grades kindergarten through 12th grade

I came here as an F1 Student when I was in 12th grade.. So I know for a fact that F1 status is available for highschool students too.. But there is a catch to it. If you are on a f1 student, you have to pay tuition even if you are attending a public school.

IMHO, the school probably dropped the ball somewhere and you can get her back in status by contacting USCIS and filling out some forms... It is not the end of the world!!! Make an Infopass appointment with your local USCIS office and ask them for advise.

Woaw, thatI did not know. A while back we were trying to get one of my brother here to study in Highschool, but the embassy said they would not issue him a visa unless he had his highschool diploma. The other way was for him to find a family here that would invite him and he would then be eligible to be a foreign exchange student. That's what I love with this forum, you learn so much!!!! Thanks guys for the infos. Anywho, like well said it is not the end of the world. The INS would tell you to leave the country when out of status, but really all you have to do is find out where the ball was drop as said above either by infopass, or just file to get back in status. Itis easy, cost about $400, and takes up to 60 days. In my case I was back in status in less than 30 days. So good luck!!! You won't have to cheat after all lol!!!(jkd)

When I went to the embassy to get interviewed for the F1 visa, the only things that the officer was interested in seeing was the receipt that showed that the tuition was paid in full and the I-20 issued by the highschool.

yeah there is some level of flexibility with f-1.. u can lose status and regain your status by going back to school or even enrolling in basic courses. i've seen it happen

I'm an F1 student, my spouse's naturalization is currenlty pending (waiting for interview letter).

Hope all goes well when he had his citizenship. I don't have a plan to pay $$$$ again for this coming fall sem.

I gave my advisor a copy of the I-130, she told me that if I already have the NOA for I-485, I could terminate my F1 status then... :clock:
