H! Guys!

i'm new with this thing..really.. :)

but this is not about me,its about my fiance's mother.

His mom is already living in the US with them,and they applied an I-130 last November..

what happened is that his mom hired a lawyer to process it..but it seemed that they were not informed of what is happening to the case..

i am trying to help him with this,

is there a page here in VJ that shows a process for that?? hehe..

and now,when we checked in the uscis.gov for the case,it says that,the case was already sent to Harlingen,TX last June 8,2010 and they have to wait for the interview..

my question is,

who is doing to schedule the interview?

are we going to receive a letter?

how long will it take?

what will happen next?

Take a copy of the NOA-2 letter on the I-130 case # , submit it with the I-485 to the address listed IN the NOA-1 receipt notice.

Who knows? maybe the 'lawyer' did submit I-130 and I-485 together, maybe he did not.

No. The copy was already submitted when you sent your I-130 Application. Upon getting the email from NVC for the interview schedule usually they send checklist on what you have been submitted and what needs to bring in your parent interview. Goodluck.

Since the mother is already in the country, it's an 'Adjustment of Status' case, and not a 'visa' case.

Any interview will be at some LOCAL USCIS office.

You should really review everything that was sent in to USCIS, to determine exactly WHAT is being filed 'for'. Major forms have form numbers, so at a minimum, create a list of form #'s that were submitted.

Finally, and pardon - I thought this topic was for people that are filing overseas, ie - interview in foreign country. That's not the case for his mother, and I suggest you jump to a different forum - http://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-tourist-visas/ - do some review there for a bit, as well.

To repeat - most ppl that adjust, that are already in USA on OTHER visa, file I-130 and I-485 concurrently. If not concurrently, then the I-485 is filed AFTER the I-130 receipt notice arrives (NOA-1 ) . The lawyer is not the grand custodian of the paperwork - yer fiance signed much already - it's HIS name/signature on the I-130 as the PETITIONER, so it's HIS paperwork. You should suggest to yer fiance to get a handle on what has been done, and what has been filed, and what has come back (reciept notices, approvals, RFEs ) and WHEN.

Congratulations in Advance... I don't think she'll be able to pick up

her visa at the embassy. I've read on some threads that they were able

to do that but it is up to the CO's discretion. On my mom's experienced,

She asked the CO if she may pick up her visa but He said NO and that they

don't allow pick up not unless it is emergency travel. If your Mom's

address is in Metro Manila, She should have her visa delivered within 2

days. Also, She needs to call the CFO for appointment because they do not

allow walk ins anymore. My Mom didn't know it but they accomodate her

because she let them see her ticket that she is leaving to San Francisco

that same day.

Thanks, Joanne! You were right. The CO did not allow her to pick up her visa absent the actual plane ticket. She lives in the province so Air21 said it would take 7-10 days to deliver her passport with the visa. What a real bummer! We thought she could be here next week and were ready to buy her visa as soon as we knew this morning. Now, I don;t know if I can chance buying her ticket for the end of July. Anyway, I am happy that she passed the interview and she was asked only three questions: What is your birthday? Who is your petitioner? What does your petitioner do?

She is 65 years old and is exempt from the CFO seminar but she has to have her visa stamped, I think so I will advise her to call the CFO if she needs an appointment to do that.

Our visa journey is almost over. Thanks to you and to all others for your support!

Filipino migrating to another country. An intending immigrant needs

to attend a 4 hours seminar or PDOS (Pre-Departure Orientation

Seminar) after the seminar they (CFO) will issue a sticker into the

passport and you need to pay or your parents will pay 400 pesos each.

If your parents are 65 years or older they are EXEMPT. Though, they

still need to go there and have their passport stamp or something.

BTW, How your Mom's case doing? Best of Luck and keep us posted!

Where and how do they schedule that seminar? Thanks again! I didn't realize there's another step to do before the actual flight.

Thanks Joanne! The interview went well though my dad got into an accident in the 1970's and he had to go to court for that so there's a record of it at the NBI. Sure enough, it was asked during the interview and he showed documents (from the 1970's) that the case had been dismissed. They were told that the embassy will have to call the NBI themselves to verify. My parents were told by Air21 that their passports (I guess with visa - hopefully) will be delivered in 10 working business days. It's been 3 days so far so I'm very anxious...

You can make an appointment thru CFO website for their pre departure seminar but if your parent is 60 years old and up they don't need to undergo the seminar and just need to go their walk-in for the CFO sticker and pay only Php 400 for each
