Guys,

when it comes to petitioner's birth certificate, do I have to send an original? What is a certified copy? If I translate my birth certificate myself and notoraze it here - will this be suficcient or will they only take an original or a copy from the issuing entity? I would prefer not to send the original, since it's the only copy I have and I cannot get a certified copy from where it was issued.

How do we schedule the appointment at the US embassy abroad? The NVC operators said they will schedule the interviews for May on the second week of April. Well, it's the second week already but I haven't received any email from them about the interview schedule. I just want to know beforehand as my mom has to prepare for her medical as well.

Anyone who has interview schedule already?

Treyu,

I just called NVC today and they said that interview dates should be out no later than Friday (April 16th). If in any case you didn't hear from NVC by mail or email give them a call on

Monday (April 19th).

I am eager to know the interview date too so my mom can arrange her stay in

Manila.

Good Luck to us. Hopefully, we'll received an email for the interview date

P.S.

NVC will schedule the interview... K-1 applicants

Yes you have to send in Petitioner's and Beneficiaries ORIGINAL Birth Certificate and Marriage Certificate or Certified copy of the same that is issued by the same agency(authority that issued BC and MC).

Hello,

Can somebody please tell me the difference between filing an I-864 or and I-864A or and I-864EZ?

I am sponsoring both of my parents, I am married, we have 1 daughter and we do our taxes together. I am totally confused and the USCIS website doesnt give you the difference for each of them.

Any help will be greatly appreciated!!!

Thank you so much!

Bunnyta

Based on my research, I-864EZ is for the petitioner to fill out when his income is sufficient to sponsor the beneficiary. There must be only one beneficiary to sponsor in order for the petitioner to use the I-864EZ.

As for the I-864A, that is for the household member whose income the petitioner will be using to sponsor the beneficiary/ies. In this case, the petitioner himself also has to execute on his own an I-864. Remember, even if the petitioner has no income, he still has to execute an I-864.

The I-864 is for the joint or co-sponsor who is not a household member. As I have mentioned, the petitioner also has to execute an I-864 when the I-864 EZ does not apply to him (like when his income is not enough and the petitioner needs somebody else to be co-sponsor, either a household member [i-864A] or somebody else not living in the same house [i-864 also]).

Did I make this clear or even more confusing? no0pb.gif

Bunnyta, to make this Affidavit of Support thing more understandable, you can answer the following questions:

1. Are you the petitioner?

2. Are you sponsoring only 1 person/beneficiary?

3. As a petitioner, is your income enough to sponsor the beneficiary without help from anybody?

- If your answer to questions 1, 2 and 3 are all yes, then you should fill out I-864EZ (as in "easy" because this form is shorter and much simpler than the regular I-864).

- If your answer to any of the above questions is "no", then as petitioner, you should fill out the regular I-864.

WHEN THERE IS MORE THAN ONE BENEFICIARY

4. Even if you are the petitioner and your income is enough to sponsor the beneficiaries, but there are more than one beneficiaries you are sponsoring, then you cannot fill out I-864EZ because that form is only used when there is one beneficiary. Petitioner should fill out the regular I-864.

WHEN PETITIONER'S INCOME IS NOT ENOUGH TO SPONSOR BENEFICIARY/IES AND NEEDS HELP FROM OTHER PERSONS:

5. If you are not the petitioner but a household member (living in the same house as the petitioner), then you should fill out I-864A. Please note that the petitioner should also fill out the regular I-864. The beneficiary will then have two sponsors: the household member who will fill out the I-864A, and the petitioner who needs to fill out the regular I-864 (even when there is very little or no income at all).

5. If you are not the petitioner and not somebody who lives with the petitioner but your income is needed to sponsor the beneficiary/ies because the income of the petitioner is not enough, then you should fill out the regular I-864 form. Anybody who is a citizen or a green card holder can be used as a joint or co-sponsor when the petitioner's income is not sufficient to sponsor the beneficiary/ies.

Other VJ'ers, please feel free to add or critique on this.

I hope this helps, Bunnyta. It took me a while to figure all these out myself.

I know, I got really confused!

This is my situation and this is what I think I have to do now:

I am the petitioner, I am sponsoring both my mom and my dad. My income is not enough to cover both of them since I also have to count my husband and daughter, so, I think what I have to do is:

File one I-864 for my mom and one for my dad

Have my husband file one I-864A for my mom and one for my dad.

I hope I got it right and please, if somebody can confirm that, I would really appreciate it.

Thank you so much!!!

Sachinky,

It is required for parents cases at both the stages and at I-130 stage you need a copy of BC and need to send ORIGINAL or CERTIFIED copy(issued from the same authority) with DS-230. Check the link below and also NVC issues RFE if you dont send in ORIGINALS with DS-230.

Thanks, Raj

Sachinky,

It is required for parents cases at both the stages and at I-130 stage you need a copy of BC and need to send ORIGINAL or CERTIFIED copy(issued from the same authority) with DS-230. Check the link below and also NVC issues RFE if you dont send in ORIGINALS with DS-230.

Thanks, Raj

Thank you Raj.

I am just curious did all of you send your original Birth certificate when filing for parents? I just feel realy uncomfortable sending the only copy that I have. When can I get it back and what if it gets lost? Sorry for being paranoid, but... anyways,I just want to know if everyone sent in the original or maybe there's somebody who submitted a certidied copy done here?

Thanks

Yes, i did send mine and based on the postings here others did send theirs too. You will get all the ORIGINALS back at the time of Interview. You can send in the certified copy but it has to be issued by the same authority(office) that issued BC.

Hope this helps..Good Luck! Thanks, Raj

Bunnyta
