Congrats! I just checked my email too and got the email notice for the interview

got the email notice for interview today as well! :dance::dance:

May 21,2011: Called NVC got case number

May 26,2011: called NVC to set up emails

May 26,2011: received an email from NVC- P3AU english(stating the visa is not available for your use)

NOTICE FOR ANYONE APPYING FOR A PARENT (IR-5).

I HAVE JUST GOT A RFE FROM THE NVC. NEW GUIDELINES ARE THAT THE PETITIONING CITIZEN MUST INCLUDE WITH THE DS-230 A ORIGINAL OF THE PETITIONERS BIRTH CERTIFICATE AND MARRIAGE CERTIFICATE AND ANY DIVORCE PAPERS.

I will overnight them to NVC and hope it does not slow us down too much.

Above you mentioned that NVC asked you to send present marriage and previous divorce papers. Did you send divorce certificate or previous marriage certificate? I received an email for petitioner previous marriage certificate. I know it says on the NVC website

Can you please let me know.

I am getting ready to send originals back to NVC, but I do not have the previous marriage certificate. In the country where I had divorce you can not obtain marriage certificate after divorce. "ZAGS" issues divorce certificate.

So you sent divorce certificate and they still requested previous marriage certificate. Did you write a letter stating that marriage certificate was unobtainable? or Were you able to get another copy of your previous marriage certificate? The country where I had divorce has different regulations. The marriage certificate is not issued if marriage has ended. I was thinking to write letter and explain the situation and provide them with the divorce certificate. What happens if we can not provide that document, if it is unobtainable. Does anyone have similar experience?

Why they need marriage certificate if we are officially divorced from that person. I know it says on the website, it just does not make sense.

It seems quite early for an interview at 6:30am. Thought American government wouldn't start working till 9 or so :)

Called the NVC as well & got my parents interview date: JAN11 @ 6:30am. :dance::dance:

That makes me wonder as well but it says there on the email 6:30am :lol: . So i'm thinking that they won't open until 7-7:30 maybe and they will be the 1st one on the line. We'll see but i'm happy to finally have their interview notice on hand. :D

actually it didnt make sens to me iether when you send the divorce paper why the hell you need previous marriage certificate,

when i submit all the paperwork i didnt submit this previos mariage certification , thinking they dont need but i got RFFE only for that so i had sent it to them(i had a extra copy at home since the marriage was made). im not sure if you could get it now but i believe you could get like a paper from your country stated that this marriage was this date you know something like this . before you do that try calling them and ask them that in your country i cant get this certificate cuz of the law there.

HI guys,

My parents went today for interview and the counsular request it more paper likecourt paper ( if applicant is criminal or something like this) and a bunch of other documentations which some of them i did submit it but they needed translate and notorized (which as per NVC they dont need them translate and notorized).

i feel like crying its 5 am and im writing this so dissapointed. The counsular didnt hold the passports they told my parents to make ready this papers and bring them until Thursday. im not sure what to say anymore. its been like 6 moths running ther and there to get this papers andin the end they need more . im so upset . hope for best .

Does anybody know if they have a right to denial forever this visa or do you think if they will get the visa after the papework as submit it?(maybe doesnt make sense but im so upset)

Thaks for info.

I called NVC several times and expalined them the situation. Operators have limited knowledge and information. They suggested i write a letter, statement and explain why I can not provide previous marriage certificate. When I asked them will this letter be accepted, she replied she does not know. At least she gave me an idea what to do. I have send an email to NVC explaining that certificate is not obtainable, detailed info, etc and 3 weeks later receive reply. This is what I have received after 3 weeks.

"Dear Sir or Madam:

Your inquiry has been received at the National Visa Center (NVC).

The NVC is required to collect the petitioner's birth certificate and/or

marriage certificates (current and previous) for all IR5 (parent of a

U.S. Citizen) and F4 (sibling of a U.S. Citizen) cases. Please submit

the requested documentation so we may continue processing this case.

The correspondence submitted is currently under review.

You will be notified when this review and any appropriate action has

been completed."

I am thinking to send the letter, original birth certificated of petitioner and beneficiary and divorce certificate of petitioner' previous marriage. Mean time I will have my parents go to the Justice Ministry and obtain some kind of paper that will say I was married on this date to the person, registry number.

Still it will not be exact marriage certificate that they are requesting.

Hi Nela

They will not deny the visa if you send the documents. If you have put something on DS-230 about court then they will ask for it. If they do no have any record, trafiic tickets, etc then they should be fine. Have the other documents translated and notarized and your parents can take them in. They will review just those documents and probably issue the visa the same day.

Hi! When I read the forum in here yesterday. I called the NVC right away and asked for the current status of my mother's case and then the operator said that her interview will be on ....... and he said that they're fixing to send the email. And then when I read Mooninlove's message about the email and then I checked my email right away and I got the email too. So please try to call NVC and do the same thing of what we did..so we probably has the same date too..Good luck!

I have same situation.

I have filled I 130 for my parents and I am Divorced one time. I don't have marriage cert for that marriage. I do have Divorce paper from Court.

I don't think even Indian Govt will register that marriage now since it was never registered. How should I go with this situation.

Also when I send papers for DS 230 should I sent Noterize copy of current and divorce papers or original. I am scared that what if I loose original.

If I submit original how they will return back to me ? Will they give it back to my parents while interview or they will post back to me in USA ?

You can send either originals or certified copies. Certified copy ofthe original is bearing the original seal or stamp from the issuing authority.[/font]

I have sent certified copies, it was not accepted. I am sending originals and it will be returned to the parents at the time of their interview.
