2005 tax return

On April 15, 2006 - so more than 2 months ago - we sent off the 2005 tax return to Philadelphia IRS center (because we had to request an ITIN for our Canadian dependent). Since then the only thing we have received was the ITIN, nothing else, no letter regarding the return, no check.

Is it normal?

were you expecting a refund? Unless you were, I don't think there is any sort of receipt from them to notify you that they got your return. Which the obviously did because you've got the ITIN.

If it was sent late(-ish) and you were expecting a refund, it may take a couple or few months to audit and process. Sendng a return on the deadline date is rather late and could slow it down some.

Yes, we were waiting for a refund, but I didn't expect to take so long. One month ago I've got the money (direct deposit) and the assessment letter from Canada Revenue and I sent the Canadian return on the same date with the American one (April 15, 2006).

As a comment for the Canadian return, they made some mistakes in assessing my return by:

- considering me only part year resident and thus lowering my credits (although I have included the note showing that my 2005 income was only from Canadian sources) and

- including in my income the EI benefits received after I moved to US.

The instructions on how to deal with emigrants are very clear, I can't understand why those CRA people don't read and apply them. I called them pointing the mistakes, I will receive an answer in 16-20 weeks

You can check on the IRS website. It should tell you the status of your refund.

You have to go to the "where is my refund". It also gives you phone numbers to contact regarding your claim.

I was in your same situation. It was in July before I got my refund from the Philly office with the ITIN. And I was unable to check my refund on the IRS website. It told me to call the IRS number. Which I did and they said since it was a paper return at the Philly office it was different and would not update on the website. Eventually I did get my refund check in July of 2005. And they sent my check with interest. And an apology letter for the processing delay of my refund.

However--this tax year I received a 1099 for the extra interest that the IRS paid me--yeah that's right even though they took extra long to process my return and give me my refund and then they gave me extra money as interest--they made me declare that extra money as income for this past tax year. What a joke.

How did you file your 2005 IRS taxes? If you claimed US residency, I don't think you can expect Canada to treat you as a full year resident. Mind you, I know nothing about how you filed, so I am just spouting off.

In US we filed married filing jointly with 2 dependents, one of them living in Canada and the other one in US. For our dependent living in Canada it was issued an ITIN and this is the only thing we have received so far from IRS.

As for Canadian taxes, being an emigrant there are special rules that apply in the departure year. One of them is if the income for the year was more than 90% from Canadian sources than the individual can elect to be treated as a full-year Canadian resident and have all the federal and provincial credits as any normal Canadian resident.
