I-864 question..

Hey Guyz,

For some reason, this question keeps haunting me ever since I started on this form.... I make well above poverty line so I am not worried about that. My worry is, putting the correct answer.

Option 1:

I got employment letter and it states what I've made in year 07, 08. For year 09, it only states what I've made so far instead of 'current' salary. Which means, anyone at NVC who is looking at it would have to do a lot of calculation (bocz it also includes yearly bonus) to figure out where I got the # in question 23.

Option 2:

Other option is to put salary for 08 since it is listed on the employment letter. But it is less than year 07 (no, I did not get demotion). I just doesn't include other income such as interests, dividends, etc. Since I don't plan to send anything related to tax for year 08, they'll wonder why does my 08 income different from what is listed in employment letter.

Please help...I am so confused...

I am no expert and am still going through the process, but I would suggest to send your IRS transcripts instead perhaps? Or get a more detailed letter from your employer - perhaps draft it for them?

I wish I could draft letter for my employer. They're one of those Fortune 500 companies who would not deviate from their "Standard" employment later...sometimes it suck working for big companies...

Thanks Anh map. You're right about employment letter. It does show position, salary, and compensation. I've not filed taxes for year 08 (I plan to file extension). So does that mean I should use whats written for 08 on employment letter or what is on tax return for year 07? (Year 07 seems like too far back).

I wish I could draft letter for my employer. They're one of those Fortune 500 companies who would not deviate from their "Standard" employment later...sometimes it suck working for big companies...

I have worked for several big companies in Australia and overseas. Lodge a formal complaint to your HR department. These companies usually have very fair policies in place for resolving greivances. Technically the letter is not standard as it does not include all your income and benefits - perhaps they need to review the process and perhaps you are the one to do it!

What should he put as his current income in he is still on unenplyment?

His anticipated annual income.

All anyone can ever put is the anticipated annual income, when we are talking about the current year. Even someone who is employed could get laid off or change jobs or have a cut or increase in pay.

As for the letter champi - you could simply attach an explanation that your current annual projected salary will be - whatever - and that your employer has only stated your year to date earnings in the letter.

but we have to have a prove for this anticipated income! his unemployment ends in April - i have no idea how to handle this!

champi, your question is complicated because I had to read it several times to understand exactly what you are saying.

The answer to your question is as above. On the I-864, if you are doing it now, they want the income from your 3 most recent tax years (read more about that in the I-864 instructions if you want).

To add even more complications to my question, I also worked for 3 months in year 08. I am just going to ignore all the complicated stuff, and go on and put 08 salary (which should be same for 09 since we've been told that chances of getting raise this year are very low ). Since my income is way above poverty line for 2 people, I hope they don't fuss about it.

For 3 most recent tax years, it will be 05 to 07. I still have not applied for extension and do not plan to till I send out my AOS package (which should be soon, just waiting for AOS bill to show as PAID on the website).
