ok well i applied for AOS in february 2009, Me and my son got our NOA, and we even went to do biometrics, then we get an RFE saying that my brothers i-864 petitions doesnt have enough evidence, he is self employed and takes care of old people, so he doesnt have pay stubs or w2's, he wrote a letter statis his self employment and how much him and his wife, because she is a household member and is also using her income to help, Now when i asked them if they have anything that we can send in, they dont, so what do we do now??, we have a few people that are more than willing to file a i-864 for joint sponsor, but in our case its not that the original i-864 isnt sufficient, its that they dont have suffiecient evidence, CAN WE STILL FILE A JOINT SPONSOR? we have been waiting so long for this and paid alot of money so if anyone can please give us feed back it would be gratly appreciated, thank you

Even though your brother is self-employed, he should have evidence of his income, such as tax returns. You can get these from the IRS for free to be sent in with the affidavit. nAs long as he has been paying his taxes, the IRS will be able to provide these. You should request the last three tax yrs. returns.

We did we provided everything, and they still ask for a letter of employment

Then you didn't make it clear that it's self employment.

In a case of self-employment, you should include a letter from the bank showing deposits (as per the instructions), so you can show you had steady income.

I am not clear, did he also supply a last income tax return initially?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

yes everything was submmited, i really would like to go the joint sponsor route cause my uncle is acting iffy about giving his bank statements, can someone tell me if i can do the joint way?

That's understandable, put yourself in his shoes.

Look for another co-sponsor.

If your uncle is unwilling to supply the documentation you will have to find another sponsor for the I-864
