VISA DENIED

Stephen just called me (6:45am - March 23rd 09) and told me his visa was DENIED? He said they told him our relationship WASN'T bonified, can you imagine! He said the interviewer had the nerve to ask him WHY DIDN'T HE EVER GET MARRIED (because he's 50) before, Stephen replied "because he never met his SOUL MATE until now (meeting me)." He said the interviewer told him that he feel Stephen TOOK ADVANTAGE OF ME (LIKE I DON'T HAVE A FREAKING MIND OF MY OWN TO MAKE MY OWN DECISION).

OK, enough of me ranting ... If I ever needed Vjers, it's NOW, WHAT DO I DO NOW? Do I contact my Congressman (they just opened an office in my town)?

Contact Sen. Mark Warner's office. Forget Sen. Jim Webb...his staff is useless in constituent services.

If a US Citizen is not currently a registered voter, does the US Citizen still get responses/actions from the congressman's constituent services?

the FIRST thing I would do is contact the Counselar General of the Embassy in question. Find out exactly what the C.O. reasons were (you'll probably get some double talk). Still, you as the petitioner have the right to request this. Past that point, yes, contact the person from your Congressman's office, & make contact with the liaison for U.S.C.I.S.. good luck

Sorry this happened to you. Contact the embassy and also contact your congressman. Try to have the case remain at the embassy. If it wasn't too expensive I would say fly there and demand reasons why they denied and when they do tell you provide what they need but I think at theis point the senator/congressman will do. Do contact the Nigerian embassy. Good luck. Will keep u in prayer

The first thing you do is get a scan or fax of the paper Stephen was given by the CO. Tell us exactly what it said. If they want more evidence give it to them. If they say they are returning it, take action to stop them as others have indicated.

Again first step is to know exactly what the paper says. As detailed a report as possible, (similar to a transcript) of the interview experience should be written up as quickly as possible when it's still clearly remembered. What questions were asked? What were the answers?

Facts are cheap...knowing how to use them is precious...

so sorry to hear that your fiance was denied...from my experience and experience of K1 friends, documents/evidence of relationship is very very crucial in k1 application...complete is sometimes not enough...sometimes more than complete is needed... an interview that turned out like his did is usually a result of a not-so subtantial documentary evidence...so the interview was his chance to explain more and better what your docs couldn't.

your fiance should have been more elaborate about his answer especially when the interviewer said he felt he was just using you...it was a challenge to your fiance to prove him wrong with a good answer.

good news is you can petitiion for review and reverse of decision but this time make sure you don't give COs reason to question any aspect of your relationship...go back to your documents...make sure you put in more evidence...pictures letters, receipts...events, travels etc and think of all possible questions that might still be raised and make sure you come up with sibstantial answers.

Call your senator and congressman and see which has a imigration specialist on their staffs and get them working on why you were denied ASAP.

Been there , done it!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

you can get married in nigeria and then ask for the visa K3.

i saw one case here of denied K1 but they succeeded by getting mùarried and processing the K3 visa.

Marriage: 01-26-2032

homesick: 01-30-2032

Divorce: 10-13-2032

you will stay married for 290 days.

I saw your post and my suggestions/questions are:

Why didn't you go to the interview? I hear that the African embassy especially Nigeria are very hard to get through and you not being there could've sent a red flag to the CO?

What did you send to Stephen as evidence? I sent my SO a 12-page scrapbook, all receipts and U.S. post office correspondences, 64 photo album filled up, all our emails and I mailed him a card everyday for two months. Now here's the funny part; my package arrived to him the day after his interview and was no use. Thanks to Jamaica's slow-*** postal service. My SO went to the appointment with still a boat-load of info and whatever pictures he had. I was able to track my box that I sent him and saw that it was still in Customs 12hrs. before his appt., so I scanned everything I sent to him in an email. He was blue-slipped and I had to end up going to the interview anyway, but I'm certain if he wouldve had that box that I mailed to him at his original interview he wouldve gotten approved.

Just to echo the other posters, call/email embassy today for an explanation, find out exactly what they gave him and take it from there. If he was denied for a certain period of time it may be harder to do anything before that timeframe is up. I don't know if Congress can/will help, but hey its worth a shot. I'm praying for ya, girl.

Extensive information has been gathered on this subject, and can be found by following the link below as well as links in my signature. There is a wealth of information on what happens to a returned petition/application, and what your options might be. One thing you need to understand is that this is not a hard denial, it is only a refusal to issue the visa.

The DOS can only return the petition to the USCIS for formal review and recommend a revocation. Once a petition/application has been returned, the DOS has no authority to stop the return process either.

I do suggest reading as much as you possibly can on this, and speaking to others this has happened to. Good luck to you, and I am so sorry this has happened...it is more common than most think, especially at high fraud posts. Just know that you are not alone, and you do have options. However, key to fighting this is arming yourself with knowledge about the return process so you completely understand your options.

I am sorry this happens to u!!! My advice is if u try every other thing and it didnt work, go ahead and marry your fiance and apply for k3.U will sure get that!!!

I was so distraught (this morning) that I didn't read what you wrote correctly. You are CORRECT, Senator Mark Warner is Virginia's 2nd Senator.

Senator Jim Webb and Congressman Tom Perriello have an office in Danville, Virgina so I decided to go with Webb. I was told that my K-1 denial case will be the 2nd case Senator Webb will be working on and to date there has been POSITIVE RESULTS with the current K-1 denial case.

I did mention that I was told that Senator Jim Webb staff is useless in constituent services ... she responded, "there is a NEW ADMINISTRATION now." I also mentioned that I VOTED for Webb (and Perriello, I really did) and that's why I'm requesting his assistance in this matter.

At the bottom of the Information/Privacy Release do you remember it saying: "While I am happy to work on your behalf, as a matter of Congressional courtesy, my general policy is to avoid working on constituent cases currently being handled by other Senators or House members from Virginia. Having multiple offices working on the same matter may cause delays in the resolution of your case, thus I encourage you to continue working with that member."

Hi 'Paris Heart'. Stephen already sent the denial letter and I already submitted my request for Senator Jim Webb assistance with this matter. I was given hope (by the Secretary) by being told that Senator Jim Webb is currently working on another K-1 denial and to date the results are POSITIVE. Oh, forgot to mention, the reason for denial is: "The bona fides of the relationship have not been established. The petition will be returned to the Department of Homeland Security with a recommendation that it be revoked." They got some nerve!
