i've been here only for a week, i posted this question before but can't find which discussion anymore and i have no idea where to post this best....my fiance(USC) filed a K1 on March2008, still on AP/security clearance check and stucked at USCIS. said check may take 180days,so they say, from oct2008-april2009...i just dont understand why it has to be exactly 180 days and what's taking it so long..last time he called, they said they will make referral and it may take another 45 days, not even sure whether they'll take action or not, so as the USCIS phone receiver said.

you'll probably tell me to wait until april 29 and hope we'll hear result and progress.

my question is, if we decide to get married, what will happen with the I129F application? is he going to refile K3 or which one is better? if we get married while K1 is on file, i understand circumstances will change since he wont be petitioning for a fiance' anymore..so if we get married, will the k1 be automatically cancelled? or we can upgrade that to K3? or CR-1 is better and forget k1/k3?

SO CONFUSED...PLEASE HELP !

If your fiance has some problems in the past then getting married won't solve anything.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

If you get married, like you said - you will no longer be a fiancee and your application will not be able to be approved. It would not be automatically cancelled, you would have to cancel it as far as I know. There is no way to "upgrade" to a K-3. You would have to refile for a k-3/cr-1 and go though the waiting process again. I would assume if your K-1 petition is stuck in AP right now, chances are a new petition would get stuck in the same way? Don't quote me on that, just seems like that would be the case.

5/14/09 - Received Biometrics appointment letter - Appointment is June 2nd.
6/2/09 - Biometrics at Raleigh field office - they were some of the nicest people :)
6/18/09 - EAD approved and card production ordered
6/20/09- received AP papers in the mail
6/22/09 EAD card arrived in the mail (that was fast eh?)
7/09/09 - received notice of GC appointment date
8/07/09 - Green Card interview at Raleigh Field office at 8:45am - Given RFE for I-693 Vaccination suppliment
9/08/09 - returned RFE to field office. Approved for Green Card
9/09/09 - Received email that Card production had been ordered.
9/17/09 - Green Card in the mail - No more USCIS until June, 2011 :D

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

yeah,i'm really trying to hold on....keep hoping something good will happen soon with our case, or i'd be more happy to hear antyhing that the uscis will say, as in anything, whatever it is...just to be sure our case isn't missing. well, nothing i can do except hold on and wait..and pray! thanks guys!!
