Filed Single On Tax Returns

Hi,

I got married to my wife on 12/27/2007. I am currently waiting for my case to be completed at the NVC.

For my 2007 and 2008 tax returns, both which were done after the marriage, I filed as "Single". I asked my accountant if I should list "Married", but he said since my wife did not have a SN # yet, better to leave it as single until she gets here.

I was wondering if this will raise any questions with the NVC or at the interview. I noticed there was a third option on the 1040, "Married but filing separately", but even that asks for wife's name and SS #. Should I have used that option or something different than "Single"? I hope I don't get a RFE due to this issue.

Any advice?

There is a couple of threads around here dealing with that exact issue. Some people got IN numbers (someone correct me if wrong name) so they could file married while spouse didn't have a SSN.

I filled as single because my CPA told me since at no time did my husband or I share a home in the USA, we could. It saved time and paperwork.

You can always file and go back and amend later.

I haven't seen anyone with problems because they filled as single at interview. It is not a problem with the NVC.

You should have filed jointly by submitting a W-7 with your return to get a ITIN from IRS.

I did so with success while my wife was still in the Philippines. Looks good for the interview. We had joint ITF bank account also.

Ok, thanks. I don't think my accountant knew about W7, just said to file Single as no SN #. Don't care about amending to get extra cash back rite now, as long as NVC and interviewer don't care, I'm good.
