Hello,

Erin is about to send the in the documents to start to the process, one of which is her birth certificate. It states that it is an offence to copy, so does she need to send in the original ONLY? will she receive it back? or does she need to get an 'official' copy.

Many Thanks

Dave.

This question came up recently. I recall that the prohibition against copying doesn't relate to personal use. Check with the appropriate state agency if you're really worried.

For the 129F only a copy is required, not certified copy.

Or you can use a full copy of your passport. See the 129F instructions for all the details.

You will need some certified birth cert copies as you go through life. Why not get a couple now and then there is no worry.

If she is really concerned about being imprisoned for making a copy of her own birth certificate, for her own benefit, then she can obtain a duplicate original. DO NOT count on being returned anything that is mailed.

You can legally make a copy of your own birth certificate.

It's like those tags on the pillows/mattresses "do not remove" tags, fine for you, not for the original sellers.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

Send a photocopy of a certified copy. Really, it's ok.

no photocopies fer sure! Uncle Sam is watching. certified is always welcome, & B.T.W., GOOD LUCK.

This is incorrect.

The above posters gave you good advice. A copy of the certified document is fine.

An original (original meaning certified long form with a raised seal for $20 or so from the County in which you were born) may be requested at the interview. It isn't for most but it was for me.

Are we talking about the beneficiary or the petionary's birth certificate?

bc you have been asked during the interview to issue the visa k1, the brith of certificate of yrou fiance (the petionary), bc in the initial post, he is asking for the petitionary's birth certificate.

I had the same problem as on my daughters certificate of citizenship it says it is punishable by law to photocopy this document.

I looked it up on the USCIS website and buried in the instructions somewhere it specifically said it was ok to photocopy documents such as birth certificates, naturalization certificates and citizenship certificates etc. I haven't got the link but I promise you they said it was fine.
