I-864 Affidavit of support question

Timeline

I am confused about joint sponsor and household member.

My brother will be joint sponsor and we share same residence. We both file separate tax returns but now I am not sure if my brother will send I-864 as joint sponsor or as house hold member I-864A. Please let me know if you had same situation.

Sent I-130 to Vermont SC 05-30-2008

NOA 1 06-03-2008

Case Transferred to California SC 11-14-2008

Joint Sponsor is a person who accepts legal responsibility for supporting an immigrant with an I-864 Affidavit of Support along with the sponsor. The joint sponsor must be at least 18 years of age, an American citizen or lawful permanent resident and have a domicile in the United States. The joint sponsor and his/her household must have the 125 percent income requirement by itself for the immigrant that he/she sponsors.

The joint sponsor is always a member of the sponsor's household. If not then you would have a co-sponsor filing a separate I-864 as opposed to the I-864A that the joint sponsor files along with the sponsor.

The I-864A is for a contributing household member. If you actually have a separate Joint Sponsor (not a household member), they will fill out a separate I-864 of their own.

OP - since he lives in the same household with you - have him fill out the I-864A.

This information is on Page 1 of the I-864A - it is really important that you read all the instructions.

Who May Be Considered a "Household Member" for Purposes of This Form?

A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;

The intending immigrant, in certain circumstances. (See "How Can the Intending Immigrant Be Considered a Household Member"?)
