Hello Vjers good day!!! Can a tourist visa marry here in US within that 6 months period? If anyone have an idea I would be glad to hear your ideas, suggestions or experiences of what are the proper process for this. It's actually not my case, it's the sister of my mother-in-law. She is here right now in US visiting her family as well as her boyfriend who is a US citizen. They're asking if they could marry even if she's only a tourist....Please your replies are highly appreciated.

A tourist can come to the US and get married - no problem. They just can not stay/live after they do so without essentially committing visa fraud.

There is no 'proper procedure' to come to the US on a tourist visa, get married and remain here to live.

Sure but I think it's not automatic that she can stay here in US as an LPR after the marriage since she came on a tourist visa. :unsure:

No, they have to apply for a fiance visa..

Doing this and filing for AOS after marriage on a tourist visa may become a shady case at USCIS. They have to be sure they are able to prove that there was no intention to marry.

Another option is to get married, come back to the Philippines and file for K1/CR1.

3.21.2014: Received email notification with case # for both petitions; case forwarded to NBC for processing

3.21.2014: Check cashed

4.08.2014: Both I-130 approved (notification received via email) - It only took three weeks!!!

4.11.2014: Received NOA2 approval notice in the mail.

5.01.2014: Called NVC to ask for status of paperwork. Advised they received both application on 4.28. Advised to call in 30 business days for an update.

6.02.2014: Email notification received from NVC that shows parents' NVC case number and instructions to pay AOS Fee and fill out DS 261.

6.03.2014: Paid AOS fee ($88 for both petitions)

yes, a tourist visa holder can get married whilst in the US. just as long as the person didn't have any intention of migrating upon entry to the US. if the person comes in the US with the intention of immigrating, then that's visa fraud.

i actually got married on a tourist visa and was able to adjust status with no problems.

She must prove that she did not originally plan to marry prior to arriving in the States. If that is the case, she can get married and then adjust her status by filing an I-485. It will be in her best interest to not leave the US until after her interview and her status is adjusted.

It is not uncommon to arrive in the states with a tourist, student or work visa and meet someone that you fall in love with. I remember in college there were MANY foreign students on student visas who in a short time found a boyfriend or girlfriend- and it was not for the purpose of obtaining a green card because they truly wanted to hook up!

There is no such law to prevent you from marrying while here on such a visa. The caveat is that is cannot be pre-planned nor the purpose of getting the visa.
